RESOLUTIONNO.14-19ARESOLUTIONORDERINGANDRESCHEDULINGARECALLELECTIONFORTHETOWNOFESTESPARKWHEREAS,apetitionwasfiledwiththeTownClerktorecallTrusteeCodyRexWalkerfromtheBoardofTrustees;andWHEREAS,inaccordancewithSection31-4-503(4)C.R.S.,theTownClerksubmittedthepetition,alongwithacertificateofsufficiencytotheBoardofTrustees;andWHEREAS,pursuanttotherequirementsofSection31-4-503(4)C.R.S.,theTownBoardshallfixadatefortheRecallElectiontobeheldnotlessthanthirty(30)daysnormorethanninety(90)daysfromthedateofthesubmissionofthepetitiontotheBoardofTrusteesbytheTownClerkanddeterminewhethervotingshallbeconductedasapollormailballotelection;andWHEREAS,pursuanttoSection31-10-108C.R.S.allrecallelectionsshallbeheldonaTuesdaydesignatedbyResolutionoftheBoardofTrustees.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ItisthedecisionoftheTownBoardofTrusteesbytheadoptionofthisResolutiontoholdtheRecallElectiononTuesday,August20,2019asamailballotelectionpursuanttotheprovisionsofSection31-10-907—31-10-913C.R.S.2.Thereshallbeone(1)precinctforthismailballotelection.ThemailballotlocationforsaidprecinctshallbetheEstesParkTownHall,170MacGregorAvenue,EstesPark,Colorado80517.3.ElectronicvotingsystemshallbeusedintheRecallElectionandthattheTownClerkbeandisherebyauthorizedanddirectedtoperformallactsandfunctionsnecessaryfortheuseofsuchelectronicvotingsystemasrequiredbythelawsoftheStateofColoradopertainingthereto.4.PursuanttoSection31-10-401C.R.S.,theBoardofTrusteesherebydelegatestotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection. 5.TheRecallElectionshallbeconductedinaccordancewiththeColoradoMunicipalElectionCode,asamended,andtheapplicableprovisionsofSections31-4-501through31-4-507C.R.S.6.TheTownClerkshallpreparetheballotinaccordancewithSection31-4-504(3)(a),(b),and(c)C.R.S.7.TheTownClerkbeauthorizedtogiveNoticeoftheRecallElectionatleastten(10)dayspriortotheelectionasrequiredbySection31-4-502(2)C.R.S.inaccordancewithSection31-10-501C.R.S.8.TheTownClerkshall,attheexpenseoftheTown,arrangeforsuchmaterialsandsuppliesforsuchelectionasmaybenecessary.PASSEDANDADOPTEDataregularmeetingheldonthe______dayof____________,2019.TOWNOFESTESPARK,COLORADOBy___MaorATTEST:¼LrtClerk
