HomeMy WebLinkAboutMINUTES Town Board 2019-04-09TownofEstesPark,LarimerCounty,Colorado,April9,2019MinutesofaRegularmeetingoftheBoardofTrusteesoftheTownofEstesPark,LarimerCounty,Colorado.MeetingheldintheTownHallinsaidTownofEstesParkonthe9thdayofApril,2019.Present:ToddJirsa,MayorCodyRexWalker,MayorProTemTrusteesCarlieBangsMarieCenacPatrickMartchinkRonNorrisKenZornesAlsoPresent:FrankLancaster,TownAdministratorTravisMachalek,AssistantTownAdministratorGregWhite,TownAttorneyKimberlyDisney,RecordingSecretaryAbsent:NoneMayorJirsacalledthemeetingtoorderat7:00p.m.andalldesiringtodoso,recitedthePledgeofAllegiance.AGENDAAPPROVAL.Itwasmovedandseconded(Walker/Cenac)toapprovetheAgenda,anditpassedunanimously.PUBLICCOMMENTS.HowardLauren/TowncitizenandCathyAlper/TowncitizenspokeonbehalfoftheCommunityRecyclingCommittee,partoftheLeagueofWomenVotersofEstesPark.TheythankedtheTownforprovidinglandtoLarimerCountyforglassrecyclingandstated14donationswerereceivedtohaulglass-onlyrecyclingtoFortCollinsforoneyearAdditionalsupportwouldbeneededandtheyrequestedtheTownengageinwaystodivertlandfillwaste.TrusteeZornesrequestedtheBoarddiscusshowtheTowncouldassistinrecyclingeffortsanditwasdeterminedrecyclingwouldbeincludedinbudgetdiscussions.CharlieDickey/TowncitizenstatedtheChamberofCommerceTaskForcewouldholdandinformationalmeetingThursday,April11,2019attheRidgelineHotel.JudyHowell/Towncitizenspokeagainstthemarijuanadispensaryissuestatingthedangersofmarijuanause.85%ofyouthaged12andupinColoradohaveusedmarijuanaandColoradohasbeenrankedthethirdhigheststateforyouthmarijuanausageinthecountry.Also,therehavebeenincreasestothenumberofviolentcrimes,propertycrimes,anddriversundermarijuanainfluencesincemarijuanasaleshavebeenlegalizedinthestate.ShestatedmarijuanadispensarieswouldnotbetherightbusinessforEstesPark.JenniferWaters/Towncitizenspokeinfavorofastormwaterutility.ReferencingtheStormwaterMasterPlan,ColoradoHazardMappingProgram,andtheSilverJacketsCorpofEngineersAssessmentonFloodMitigation,shesuggestedtheTownfirstinvestigatesmallerneighborhoodrepairprojects,secondpursuegrantfunding,andthirdacquireanin-housedynamicmodelforstormwaterrunoff.JoelHoltzman/Towncitizenspokeagainstmarijuanastatingitwasagatewaydrugandwouldcreateproblemswiththetown’syouth.HealsostatedtheStormwaterMasterPlanwouldnotworkandwouldnegativelyaffectrivers. BoardofTrustees—April9,2019—Page2TOWNBOARDCOMMENTSTrusteeMartchinkrequestedtheTownBoarddiscusschildcareissuesandsolutionsaspartofstrategicplanning.TrusteeCenacstatedVisitEstesParkmetApril2,2019andhavebeendevelopingastrategicplanwhichshouldbecompletedinJune.TheRooftopRodeoParadehasbeenscheduledforJuly9,2019andtheapplicationforparticipatingwouldbeavailableontherodeo’swebsite.—TrusteeBangsstatedtheChildcareandHousingTaskForcehasmetwithstake-holderorganizationsintownandhavedevelopedandprioritizedalistofstrategiestoimprovechildcareandhousingissues.CommunityoutreachwouldbedoneinAprilandafinalizedlistofstrategieswouldbeprovidedtotheBoardinJune2019.TrusteeNorrisstatedtheEstesValleyPlanningCommission(EVPC)wouldmeetApril16,2019andinMaytheEVPCmeetingswouldbeheldlaterinthedaywiththeStudySessioninlateafternoonwithregularmeetingsbeginningat6:00p.m.HeaddedtheChildcareandHousingTaskForcewouldattempttohavesuggestionstotheBoardtocoincidingwithStrategicPlanning.HeappreciatedthepubliccommentandsuggestionsregardingtheStormwaterMasterPlan.TrusteeZornesstatedtheBehavioralHealthPolicyCouncilmetApril8,2019andhavebeenworkingonprogramscouldinvolvechildcareissues.HeattendedthePolicyAdvisoryCommitteemeetingregardingSolidWasteInfrastructureMasterPlanandstatedanIntergovernmentalAgreementwouldbeprovidedtotheBoardsoon.Healsoattendedaribboncuttingforthenewusedbookstore‘Cliffhanger”intownandwashonoredtoprovideaproclamationforLibraryGivingDay.TOWNADMINISTRATORREPORT.None.CONSENTAGENDA:1.Bills.2.TownBoardMinutesdatedMarch26,2019andTownBoardStudySessionMinutesdatedMarch26,2019.3.FamilyAdvisoryBoardMinutesdatedMarch7,2019(acknowledgementonly).Itwasmovedandseconded(Cenac/Zornes)toapprovetheConsentAgenda,anditpassedunanimously.REPORTSANDDISCUSSIONITEMS:(OutsideEntities).1.RODEOCOMMITTEEUPDATE.TrusteeCenacintroducedCommitteeChairmanMarkPurdywhoprovidedanupdateontheRooftopRodeo.HestatedhisappreciationforsupportoftherodeoandprovidedabriefhistoryofEstesParkWesternHeritageInc.HehighlightedawardstherodeohasreceivedandstatedtheRooftopRodeowouldbeheldJuly8throughJuly13,2019withrecognitionnightsformilitary,family,andbreastcancerresearch.Trusteesdiscussedthesizeofthecommitteeinconjunctionwiththesizeoftherodeo,thesuccessoftherodeo,andthankedChairPurdyforhisefforts.2.ESTESVALLEYINVESTMENTINCHILDHOODSUCCESS.ExecutiveDirectorAlmondprovidedanupdateonEstesValleyInvestmentinChildhoodSuccess(EVICS).ShestatedEVICSwouldbecomeanofficialFamilyResourceCenteronApril25,2019andnamedtheTownofEstesparkasSponsoroftheMonthforApril2019.SheprovidedbackgroundontheEVICSmission,staff,scholarshipprograms,andchallengesEVICSfacesregardingfunding,daycareavailability,andtheLarimerCountyChildCareAssistanceProgram(CCAP)waitlist.Astateprogram,CCAP,providesreducedcostchildcaretolicensedchildcarefacilitiesorqualifiedprovidersforincomequalifiedfamilies.DirectorAlmondinvitedtheBoardtoattendtheBeReadyFaironApril13,2019attheEstesParkElementary BoardofTrustees—April9,2019—Page4PLANNINGCOMMISSIONITEMS:ItemsreviewedbyPlanningCommissionorstaffforTownBoardFinalAction.1.ACTIONITEMS:A.ORDINANCE05-19AMENDINGTHEESTESVALLEYDEVELOPMENTCODE(EVDC)REGARDINGTHE“PARKANDRECREATIONFACILITIES”USEREVISINGTHEDEFINITION,REVISINGTHEPERMITTEDUSESTABLES,ANDADDINGSPECIFICUSESTANDARDS.MayorJirsaopenedthepublichearingandPlannerWoeberpresentedOrdinance05-1910amendtheEVDCrevisingthedefinition,permitteduses,tables,andaddspecificusestandardsofParkandRecreationFacilities.TheParkandRecreationFacilitiesusehaspreviouslybeenallowedasause-by-rightinallresidentialandthemajorityofnon-residentialzoningdistricts.DuetoconcernsillicitedbytherecentapprovalofaRecreationFacilityintheRuralEstate(RE-i)zoningdistrict,theTownBoardandLarimerCountyBoardofCountyCommissionershavedirectedstafftoclarifyanddefineParkandRecreationFacilitiesusesofurtherissuescouldbeavoided.TheproposedcodeamendmentswouldclarifiyusebydifferentiatingParkandRecreationFacilitiesaspublicorprivateoposedtocommercialornoncommercial.JohannaDarden/TowncitizenandRichardRalph/TowncitizenspokeinfavorofOrdinance05-19regardingcommunityinterestandintendedusesinresidentialland.TrusteesdiscussedaninvintoryofoperatingParkandRecreationFacilitiesinresidentialzoningdistricts,reviewingtheordinanceseffectinsixmonths,unintededconsequencesofapprovingtheordinancepriortoinventoriesbeingcompiled,theexpirationofthemoratorium,risksofcontinuingtheordinancetoalaterdate,andimplementinganadditionalmoratoriumonApril26,2019toprovideadditionaltimeforinventoriestobecollected.MayorJirsaclosedthepublichearingandTownAttorneyWhitereadtheordinanceintotherecord.Itwasmovedandseconded(Norris/Zornes)toapproveOrdinance05-19.Asubstitutemotionwaspresented.Substitutemotion.Itwasmovedandseconded(Walker/Jirsa)tocontinueOrdinance05-19toMay28,2019,anditpassedunanimously.ACTIONITEMS:1.PROFESSIONALCONTRACTSFORBROADBANDSTART-UP.DirectorBergstenpresentedtheProfessionalContractsforstart-upandgrowthphasesofbroadbandoperations.Allagreementswouldhavefive-yeartermsandexpendituresforeachconsultantwouldexceedthe$100,000threshold.FundingwaspreviouslyapprovedbytheBoardbyResolution08-19.FullStackwouldprovidenetworkengineeringandadministration,backofficesoftwaresolutions,andowner’srepresentative.eStrategy3,LLCwouldprovidecontactcenterservices,sales,andmarketing.And,OldTownMedia,Inc.wouldprovidemarketingcampaigns.Trusteesdiscussedreceivingquarterlyupdatesandhowconsultantswereselected.Itwasmovedandseconded(MartchinklCenac)toapprovetheProfessionalContractsforBroadbandStart-UpwithFullStack,eStrategy3,LLCandOldTownMediaInc.,anditpassedunanimously.—TrusteeCenacrequestedastructuretomonitortheBoardscompliancewithpoliciesbediscussedatafutureStudySession.REQUESTTOENTEREXECUTIVESESSION:Itwasmovedandseconded(Walker/Bangs)toenterintoExecutiveSessionfordiscussionofspecializeddetailsofsecurityarrangementsorinvestigations—Section24-6-402(4)(d),C.R.S.,anditpassedunanimously.WhereuponMayorJirsaadjournedthemeetingat9:34p.m.toenterintoExecutiveSession.
