HomeMy WebLinkAboutMINUTES Town Board 2019-01-22TownofEstesPark,LarimerCounty,Colorado,January22,2019MinutesofaRegularmeetingoftheBoardofTrusteesoftheTownofEstesPark,LarimerCounty,Colorado.MeetingheldintheTownHallinsaidTownofEstesParkonthe22dayofJanuary,2019.Present:ToddJirsa,MayorCodyRexWalker,MayorProTernTrusteesCarlieBangsMarieCenacPatrickMartchinkRonNorrisKenZornesAlsoPresent:FrankLancaster,TownAdministratorTravisMachalek,AssistantTownAdrninistratorGregWhite,TownAttorneyKimberlyDisney,RecordingSecretaryAbsent:NoneMayorJirsacalledthemeetingtoorderat7:00p.m.andalldesiringtodoso,recitedthePledgeofAllegiance.AGENDAAPPROVAL.Itwasmovedandseconded(Cenac/Norris)toapprovetheAgenda,anditpassedunanimously.PUBLICCOMMENTS.CharlieDickeyrtowncitizenstatedhespokewiththePostmasterManagerwhowasinterestedinestablishingtheissuesrelatedtotheEstesParkPostOffice.HealsospoketoPostmasterKimChaseregardingapotentialtourofthePostOfficeforTrusteesinFebruary.JohnMeissnerrrowncitizeninquiredabouttherenewaloftheConferenceCentercontractwhichwasdiscussedattheStudySession.HeaskediftheConferenceCentergeneratedrevenuefortheTownandrequesteditbefurtherdiscussedbytheTownBoardallowingforpublicinput.MayorJirsaagreedthisshouldbeaddedasafutureagendaitem.TOWNBOARDCOMMENTSTrusteeZornesattendedtheWasteshedRegionalPolicyAdvisoryCommitteemeetingwhichfocusedonanIntergovernmentalAgreementtobeapprovedbyFortCollins,LovelandandEstesPark.HewouldbeattendingtheOpenLandsAdvisoryBoardmeetingonJanuary24,2019.TheLarimerCountyMentalHealthInitiativePolicyCouncilhasbeenacceptingcommunitymemberapplicationsforthecouncilaswellasa25-membertechnicaladvisoryboard.TrusteeNorrisstatedtheEstesValleyPlanningCommissionhasbeenacceptingapplicationsforoneTownappointedvacancy.TheFamilyAdvisoryBoardwouldmeetFebruary7,2019andthejointmeetingoftheTownBoardofTrusteesandLarimerCountyBoardofCountyCommissionershasbeenscheduledforFebruary19,2019todiscusstheIntergovernmentalAgreementandEstesValleyComprehensivePlan.MayorProTemWalkerrecognizedtheEstesParkPoliceDepartment,LarimerCountySheriffsDepartmentandRockyMountainNationalParkstafffortheireffortsinahigh-speedchasewhichoccurredinTown.MayorJirsaattendedtheColoradoAssociationofSkiTownsmeetinginJacksonHole,WY. BoardofTrustees—January22,2019—Page2TrusteeBangsstatedtheTransportationAdvisoryBoardmetandwouldbeprovidingpolicyupdatestotheTownBoard.ShemetwithDirectorMuhonenandManagerSolesbeetodiscusslicenseplaterecognitionsoftware.TrusteeBangsrecognizedFlinchForwardfortheirassistancetofederalemployeesduringthegovernmentshutdown.TrusteeCenacstatedtheRooftopRodeohasbeenscheduledforJuly8-13,2019.TheVisitEstesPark(VEP)BoardmetandwereintroducedtothenewCEOEricLund.VEPhaslaunchedtheirwintercampaign,whichincludesanewbillboard.TOWNADMINISTRATORREPORT.1.POLICYGOVERNANCEMONITORINGREPORT-Policy3.3.TownAdministratorLancasterpresentedthePolicyGovernanceMonitoringReportforPolicy3.3FinancialPlanningandBudgeting.HereportedcomplianceperPolicy3.3,statingtheTownAdministratorhasnotjeopardizedeithertheoperationalorfiscalintegrityoftheTown.However,section3.3.4hasbeenreportedwithcautionduetopotentialfinancialimpactscausedbythegovernmentshutdown.CurrentlytheTownhaswaivedpenaltyandlatefeesofutilities,limitationsoncapitalexpendituresmaycontinuetobeimposedshouldtheshutdowncontinue.InresponsetoJohnMeissner’sinquiryTownAdministratorLancasterstatedConferenceCenterrevenuesarereceivedbytheoperatoroftheRidgelineHotel.TheTownhasbeenfinanciallyresponsibleforthecenter’sutilitiesandmajorcapitalimprovements.ThecontractfortheConferenceCentercouldberenewedfor20years,howevergivingownershiptotheRidgelineHotelwouldsavetheTown$2.8million.2.STORMWATERFEESUPDATE.DirectorMuhonenprovidedanupdateontheEstesValleyStormwaterManagementProject.Hehighlightedthepublicopinionsurvey,andthedistributionofproposedstormwaterfeesandeducationalinformationtoownersof7676improvedparcels.LarimerCountyPublicWorksstaffrecentlypresentedaconcernregardingfeestructuretotheBoardofCountyCommissioners,requestingtheCommissionersconsiderafeecaportieredsystemforresidentialpropertiesonly.TheCommissionershaverequestedtheTownBoardprovideanopiniononthefeestructurebeforeitwouldbefinalizedandprovidedtopropertyowners.TheTownBoarddiscussedthefeestructureoptionsanddeterminedtorecommendOption3,tocreateafeereductionformulabroadlyavailabletomorepropertyowners.JoelHoltzman/TowncitizenspokeagainsttheStormwaterutilitystatingitwouldnotbeafeebutataxnotvotedonbycitizens.Healsostatedtheutilitywouldnotbeeffectiveandwouldnegativelyaffecttherivers.HerequestedtheBoardreviewtheSilverJacketsCorpofEngineersAssessmentonFloodMitigation.CONSENTAGENDA:1.Bills.2.TownBoardMinutesdatedJanuary8,2019andTownBoardStudySessionMinutesdatedJanuary8,2019.3.EstesValleyPlanningCommissionMinutesdatedNovember13,2018andDecember18,2018(acknowledgmentonly).4.ParksAdvisoryBoardMinutesdatedNovember15,2018andDecember20,2018(acknowledgementonly).5.TransportationAdvisoryBoardMinutesdatedNovember21,2018andDecember19,2018(acknowledgementonly).6.AcceptanceofTownAdministratorPolicyGovernanceMonitoringReport.7.Resolution#02-19SettingthePublicHearingdateofFebruary12,2019foraNewBeer&WineLiquorLicensefiledbyHighWestInvestments,LLC,dbaVinoGiu,207ParkLane,EstesPark,CO80517. BoardofTrustees—January22,2019—Page3Itwasmovedandseconded(Walker/Martchink)toapprovetheConsentAgenda,anditpassedunanimously.REPORTSANDDISCUSSIONITEMS:(OutsideEntities).1.LOCALMARKETINGDISTRICTUPDATE.ThenewCEOofVisitEstesPark(VEP),EricLund,introducedhimselftotheBoard.HestatedtheVEPstaffandBoardofDirectorshavebeenwelcoming.2.ESTESVALLEYPARTNERSFORCOMMERCE(EVPC)QUARTERLYREPORT.PresidentoftheEVPCCharlieDickeystatedStefScrogginwasrecentlyelectedtotheEVPCBoardofDirectorsandprovidedanoverviewofadditionalmembersoftheBoardandstaff.HesuppliedanupdateontheChamberTaskforce,aformalproposalwouldbeexpectedinApril2019withastartdateinJanuary2020toestablishaChamberofCommerce.ApresentationonthestatusoftheChamberofCommercewouldbeheldJanuary24,2019.TrusteeZornesquestionedhowaChamberofCommercewouldaffectsimilarentitiesinEstesPark.Mr.DickeystatedtheEVPCwouldceaseoperationshowever,eachentitywoulddetermineiftheywouldcontinuetooperate.3.UPDATEONFLOODMITIGATIONPROJECTSANDFUNDINGBYTHEOFFICEOFEMERGENCYMANAGEMENT(OEM).MichaelWillis,DirectorofOEMprovidedanupdateontheapplicationforaFEMAPre-DisasterMitigationGrantfor$1.5million,theTownwouldhavetheoptiontomatch10%ofthegrant.DirectorWillisstatedfloodmitigationprojectsaveragea6-1returnoninvestment.TrusteeNorrisrequestedtheSilverJacketsassessmentbeprovidedtotheBoard.ACTIONITEMS:1.ORDINANCE#01-19:AMENDMENTSTOTHE2015INTERNATIONALRESIDENTIALCODE(IRC).MayorJirsaopenedthepublichearingandDirectorHuntpresentedOrdinance#01-19toamendthe2015IRC.PreviouslytheTownBoardandBoardofCountyCommissionersadoptedlocalamendmentstothe2015IRCrequiringaLifeandSafetySurveybeconductedbyBuildingOfficialtoensurevacationhomesandlargevacationhomesaresafe.CountyandTownstaffhasdetermineditwouldnotbepossibletocompletetheinitialsurveyforallvacationhomesbytheMarch31,2019deadline.Thus,Townstaffhasrecommendedamendingthe2015IRC§R327tothefollowingtimeline:LifeandSafetySurveyapplicationsubmittedbyMarch31,2019,InitialsurveycompletedbyMarch31,2020andfinalcomplianceandCertificateofOccupancyissuedbyMarch31,2021.TheTrusteesdiscussedtheramificationsofvacationhomesnotmeetingtheapplicationdeadline.DirectorHuntstatedregistrationswouldbevoidedandsubjecttoreapplicationofavacationhomeregistrationshouldtheLife&SafetySurveyapplicationnotbesubmittedbyMarch31,2019.MayorJirsaclosedthepublichearingandTownAttorneyWhitereadtheordinanceintotherecord.Itwasmovedandseconded(Walker/Cenac)toapproveOrdinance#01-19withtheremovalofthesecondlineof§R327.1beginningwith‘prior’andendingwith‘home’,anditpassedunanimously.2.APPOINTMENTSTOTHENORTHERNCOLORADOREGIONALTOURISMAUTHORITYBOARD(NOCORTA).MayorJirsapresentedtheappointmentofaTrusteetotheNOCORTABoardandMayorProTemWalkervolunteered.Itwasmovedandseconded(Cenac/Norris)toappointMayorProTemWalkertotheNorthernColoradoRegionalTourismAuthorityBoard,anditpassedunanimously.3.PARKSADVISORYBOARDINTERVIEWCOMMITTEEAPPOINTMENT.TownClerkWilliamsonpresentedtheappointmentoftwoTrusteestotheParksAdvisoryBoard(PAB)InterviewCommitteeforthetwoopenpositions.ShealsoprovidedanupdateonboardvacanciesforVEP,theEstesValleyPlanningCommissionandtheFamilyAdvisoryBoard.Itwasmovedandseconded BoardofTrustees—January22,2019—Page4(MartchinklNorris)toappointTrusteeMartchinkandTrusteeBangstotheParksAdvisoryBoardInterviewCommiftee,anditpassedunanimously.REPORTSANDDISCUSSIONITEMS:1.UPDATEONTHEENTERPRISEWIDECONTENTMANAGEMENTSOFTWARE(LASERFICHE).AdministrativeAssistantBeerspresentedanupdateontheEnterpriseWideContentManagementSoftware(Laserfiche).SheoverviewedtheprogresstheTownhashadimplementingLaserfiche,howithasbeenimplementedandgoalsofautomatingover15processesin2019.Shehighlightedresearchforimplementation,resourcesavailabletotheTown,policyandnamingconventions,theTownBoardAgendaprocessautomation,processeswhichhavebeenstreamlinedviaLaserfichefrom2011-2019andbusinesslicenseandregistrationrenewalprocessing.TheTrusteesdiscussedtheamountofworkwhichhasbeenstreamlinedviaLaserficheandthegoalsfor2019specificallyintheBuildingDivision.WhereuponMayorJirsaadjournedthemeetingat8:3m.ToddJirsa,MayZKimberlyD,Recodi6gSecretaryI:
