00RESOLUTION#15-16TOAFFILIATETHEESTESPARKPOLICEOFFICERSWITHTHEFIREANDPOLICEPENSIONASSOCIATIONOFCOLORADO(FPPA)ANDFORRETIREMENTWHEREAS,theTownofEstesParkcoversitslawenforcementofficers/policeofficersunderthefederalSocialSecurityAct;andWHEREAS,pursuantto§31-31-704.5C.R.S.,theTownofEstesParkdesirestoaffiliatewiththeFireandPolicePensionAssociationforpurposescoverageundertheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS)under§31-31-704.6etseq.,C.R.S.WHEREAS,theTownofEstesPark,inadditiontoSocialSecuritybenefits,currentlyprovidesadefinedcontributionplan.NOWTHEREFOREBEITRESOLVEDBYTHETOWNOFESTESPARKTHAT:1.TheTownofEstesParkdoesherebyintendtocoveritsswornpoliceofficerswhosedutiesaredirectlyinvolvedwiththeprovisionofpoliceprotectionundertheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS)establishedpursuantto§31-31-704.6C.R.S.andretaincoverageundertheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&D-SS)establishedpursuantto§31-31-704.7,C.R.S.,andpart8ofTitle31,Article31,C.R.S).2.Suchsupplementalretirementbenefitsshallbefundedbycontributionsasestablishedin§31-31-704.6(3)C.R.S.fortheStatewideDefinedBenefitSocialSecuritySupplemental(SWDB-SS)and§31-31-811(4)C.R.S.fortheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&D-SS).3.CoverageundertheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS)shallbesubjecttotheapprovalofatleast65%ofallactiveMembersemployedbytheEmployerpriortoapprovaloftheapplicationbyFPPA.4.Ifapproved,coverageshallbecomeeffectiveonDecember18,2016,assumingallnecessaryforms,procedures,electionofthemembership,ifrequired,andotherrelevantworkiscompleted.5.Ifnotapproved,thecoverageundertheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&D-SS)shallterminateeffectiveDecember31,2016.6.TheEmployermakesthefollowingcertifications:a.Ifapprovedby65%oftheactiveMembersintheplan,allactiveswornpoliceofficerswillbecomeparticipantsintheStatewideDefinedBenefitSocial CCSecuritySupplementalPlan(SWDB-SS),andretaincoverageundertheStatewideDeathandDisabilitySocialSecuritySupplementalPlan.b.Ifnotapprovedby65%oftheactiveMembersintheplan,allactiveswornpoliceofficer’smembershipintheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&D-SS)willceaseontheeffectivedateofDecember31,2016.BenefitspreviouslygrantedtoMembersundertheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&DSS)arenotaffectedbythedecisiontodiscontinuecoverage,andthatthestatutoryprovisionsthatapplytotheEmployerwithrespecttobenefitspreviouslyawardedstillapply.c.TheEmployeracknowledgesthatthedepartment’selectiontoparticipateintheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS)andtheStatewideDeathandDisabilitySocialSecuritySupplementalPlan(SWD&D-SS)isirrevocable.d.TheEmployeragreestoparticipateintheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS)asdescribedhereinandtobeboundbythetermsoftheplanandthedecisionsandactionsoftheboardwithrespecttotheplan.7.TheEmployeracknowledgesthatifitofferspensionbenefitsundertheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS),alocallyadministeredMoneyPurchasePlanoranotherplan,therearelimitsundertheInternalRevenueCodeonthetotalcontributionswhichmaybemadeannually.8.ThisaffiliationresolutionshallberevocableatanytimepriortothecommencementofthewithholdingofcontributionsfromtheMembers’salariesfortheStatewideDefinedBenefitSocialSecuritySupplementalPlan(SWDB-SS).IftheEmployerdoesnotrevoketheresolutionpriortothewithholdingofcontributions,affiliationbecomesirrevocable.9.TheTownClerkisdirectedtofileacertifiedcopyofthisresolutionwiththeFireandPolicePensionAssociationassoonasispracticableandEmployer’sstaffisdirectedtotakeallotheractionsnecessarytoimplementthecoverage.ATTEST:c.___4.ClerkApprovedthisayofPt-csr,201(o,bytheTownofEstesPark.APPROVED:
