CCRESOLUTIONNO.08-17ARESOLUTIONTOOUTLINEPROCEDUREANDSCHEDULEFORTHEESTESVALLEYCOMPREHENSIVEPLANUPDATEWHEREAS,ColoradoRevisedStatutesSec.31-23-206providesthataPlanningCommissionshall“...adoptamasterplanforthephysicaldevelopmentofthemunicipality,includinganyareasoutsideitsboundaries,subjecttotheapprovalofthegovernmentalbodyhavingjurisdictionthereof;andWHEREAS,ColoradoRevisedStatutesSec.31-23-206providesthatanattestedcopyoftheplanorpartthereofshallbecertifiedtoeachgovernmentalbodyoftheterritoryaffectedand,aftertheapprovalbyeachbody,shallbefiledwiththecountyclerkandrecorderofeachcountywhereintheterritoryislocated”;andWHEREAS,Sec.2.1.BoftheEstesValleyDevelopmentCode(EVDC)similarlyprovidesforjointlysharedauthorityovertheEstesValleyComprehensivePlan’sadoptionandamendmentamongtheEstesValleyPlanningCommission,theEstesParkTownBoardofTrustees,andtheLarimerCountyBoardofCountyCommissioners;andWHEREAS,twenty(20)yearshaveelapsedsincethe1996EstesValleyComprehensivePlanwasdulyapprovedbytheapplicableauthoritiesintheEstesValleyPlanningArea;andWHEREAS,itisreasonableandappropriatethataComprehensivePlanupdatebeundertakenaccordingtomutualconcurrenceamongthethreeaforesaidofficialbodies;andWHEREAS,itisreasonableandappropriatefortheTownBoardofTrusteesandBoardofCountyCommissionerstoprovideleadershipandguidanceinshapingtheprocessandscheduleforaComprehensivePlanupdate:NOW,THEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado,that:Section1.UpontheadoptionofthisResolutionandconcurrencewiththecontentsbytheLarimerCountyBoardofCountyCommissioners,ageneralprocessandscheduleisherebydeterminedfora2017-2018updateoftheEstesValleyComprehensivePlan.Section2.Inordertoallowadequatetimeforallinterestedstakeholders,thepublic,andelectedandappointedofficialstoaccuratelydetermineandweighvariouselementsandaspectsoftheComprehensivePlanupdate,itisdeterminedthataminimumof12to18monthsisappropriateandnecessaryforathoroughandtransparentupdateprocess.AllelementsintheComprehensivePlanupdatewillbeconductedwithadequatetimeandattentiontopublicandstakeholderreview,with 00mutualconsultationamongthePlanningCommissionandgoverningbodiesasappropriate.Section3.Withinthe12-to-lB-monthtimeframe,thefollowingelementsshouldgenerallybeaddressed:A.AnupdateofstatisticandsimilarbasicdatainthePlan;B.Ageneraltext-basedoutlineofland-usepolicy;C.Anelementaddressingpopulationgrowth,housingneedsandhousingsupply;D.AnelementaddressingE.AnelementaddressingF.AnelementaddressingG.Anelementaddressingresidentsandvisitors;H.Anelementaddressingpublicsafetyandemergency-serviceneeds;I.Anelementaddressingenvironmentalconsiderations;J.Anyotherelement(s)asdeterminedappropriate,necessary,and/orrequiredbylaw;andK.AnelementaddressingimplementationoftheupdatedPlan.Section4.The12-to-i8-monthtimeframeshouldbeginapproximatelywhentheTownBoardofTrusteesandBoardofCountyCommissionershavebothapprovedthisResolutionoritsequivalent.Section5.ItisexpectedthePlanningCommissionwillcompleteandapproveSec.3.A(thestatistical/dataupdate),andcertifysametothetwogoverningbodies,beforesubstantiallyundertakingtheothertasksinthisResolution.Section6.Otherelements,beginningwithSec.3.B,willbecompletedwithadequatepublicandstakeholderinputandreview.Section7.TheprocessesforupdatesofoneormoreelementsinSec.3mayrunconcurrently,exceptforpriorcompletionofSec.3.A(statistics).Section8.Afterreceiptandreviewofpublicandstakeholderinputandcompletionofanyfinalrevisions,itisexpectedthePlanningCommissionwouldapprovetheComprehensivePlanupdatefollowedbycertificationtoandapprovalofthetwogoverningbodies,accordingtotheColoradoRevisedStatutesasrecitedherein.economicdevelopment;transportation;utilitiesandsimilarinfrastructure;parks,trails,andrecreationalandtourismneedsof 00DATEDthis$P’Thayof-tsce.o2017.TOWNOFESTESPARK,COLORADOATTEST:Tow’
