HomeMy WebLinkAboutRESOLUTION 15-180RESOLUTIONNO.15-18ARESOLUTIONTOOUTLINEPROCEDUREANDSCHEDULEFORTHEESTESVALLEYCOMPREHENSIVEPLANUPDATEDURING2018-2021WHEREAS,ColoradoRevisedStatutesSec.31-23-206providesthataPlanningCommissionshall“...adoptamasterplanforthephysicaldevelopmentofthemunicipality,includinganyareasoutsideitsboundaries,subjecttotheapprovalofthegovernmentalbodyhavingjurisdictionthereof;andWHEREAS,ColoradoRevisedStatutesSec.31-23-208providesthatanattestedcopyoftheplanorpartthereofshallbecertifiedtoeachgovernmentalbodyoftheterritoryaffectedand,aftertheapprovalbyeachbody,shallbefiledwiththecountyclerkandrecorderofeachcountywhereintheterritoryislocated”;andWHEREAS,Sec.2.1.BoftheEstesValleyDevelopmentCode(EVDC)similarlyprovidesforjointlysharedauthorityovertheEstesValleyComprehensivePlan’sadoptionandamendmentamongtheEstesValleyPlanningCommission,theEstesParkTownBoardofTrustees,andtheLarimerCountyBoardofCountyCommissioners;andWHEREAS,twenty-two(22)yearshaveelapsedsincethe1996EstesValleyComprehensivePlanwasdulyapprovedbytheapplicableauthoritiesintheEstesValleyPlanningArea;andWHEREAS,itisreasonableandappropriatethataComprehensivePlanrewritebeundertakenaccordingtomutualconcurrenceamongthethreeaforesaidofficialbodies;andWHEREAS,itisreasonableandappropriatefortheTownBoardofTrustees,BoardofCountyCommissioners,andPlanningCommissiontoprovideguidanceinshapingtheprocessandscheduleforaComprehensivePlanrewrite:NOW,THEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado,that:Section1.UpontheadoptionofthisResolutionandparalleladoptionofsimilarresolutionsbytheBoardofLarimerCountyCommissionersandEstesValleyPlanningCommission,ageneralprocessandscheduleisherebydeterminedfora2018-2021rewriteoftheEstesValleyComprehensivePlan.Section2.Inordertoallowadequatetimeforallinterestedstakeholders,thepublic,andelectedandappointedofficialstoaccuratelydetermineandweighvariouselementsandaspectsoftheComprehensivePlanrewrite,itisdeterminedthataminimumof18to24monthsisappropriateandnecessaryforathoroughandtransparentprocess.AllelementsintheComprehensivePlanrewritewillbeconducted 00withadequatetimeandattentiontopublicandstakeholderreview,consultationamongthePlanningCommissionandgoverningbodiesasappropriate.withmutualandhousingsupply;tourismneedsofbySection5.Itisexpectedtheremainderof2018willbespentinpre-planningtasks,withmajorworkontheComprehensivePlanrewritebeginningin2019.Section6.ItisanticipatedthattheestimatedbudgetfortheComprehensivePlanrewritewillbeapprox.$300,000,beginningin2019andendingwithadoptionofthenewPlan.Itishopedthatasubstantialproportionoftheestimatedcostcanbeoffsetbygrantfunding.Anadditionalestimated$10,000willfacilitatepre-planningworkin2018.Section7.Afterreceiptandreviewofpublicandstakeholderinputandcompletionofanyfinalrevisions,itisexpectedthePlanningCommissionwouldapprovetheComprehensivePlanupdatefollowedbycertificationtoandapprovalofthetwogoverningbodies,accordingtotheColoradoRevisedStatutesasrecitedherein.DATEDthisIOdayofc\U\Lk,2018.ATTEST:TnClerkSection3.Withinthe18-to-24-monthtimeframe,thefollowingelementsshouldgenerallybeaddressed:A.AnupdateofstatisticalandsimilarbasicdatainthePlan;B.Ageneraltext-basedoutlineofland-usepolicy;C.Anelementaddressingpopulationgrowth,housingneedsD.Anelementaddressingeconomicdevelopment;E.Anelementaddressingtransportation;F.Anelementaddressingutilitiesandsimilarinfrastructure;G.Anelementaddressingparks,trails,andrecreationalandresidentsandvisitors;H.Anelementaddressingpublicsafetyandemergency-serviceneeds;I.Anelementaddressingenvironmentalconsiderations;J.Anyotherelement(s)asdeterminedappropriate,necessary,and/orrequiredlaw;andK.AnelementaddressingimplementationoftheupdatedPlan.Section4.The18-to-24-monthtimeframeshouldbeginapproximatelywhentheTownBoardofTrustees,BoardofCountyCommissioners,andPlanningCommissionhaveapprovedresolutionssimilartothisone.TOWNOFPARKMayor
