RESOLUTION83-21APPROVINGTHECOLORADOOPIOIDSSETTLEMENTMEMORANDUMOFUNDERSTANDINGWHEREAS,theopioiduseleadingtooverdosesanddeathshasbeendeclaredanationwidepublichealthemergency;andWHEREAS,nationwidesettlementshavebeenreachedwiththe“Big3”opioiddistributors(Mckesson,CardinalHealth,andAmerisourceBergen)andopioidmanufacturerJohnson&Johnsontoresolveclaimsbystateandlocalgovernmentsthatthesecompaniescontributedtotheopioidepidemic;andWHEREAS,theStateofColoradoandparticipatinglocalgovernmentsintendtoexecutetheColoradoOpioidsSummaryMemorandumofUnderstanding,establishingthemannerinwhichOpioidFundsshallbedividedanddistributedwithintheStateofColorado;andWHEREAS,theTownofEstesParkdesirestosignontotheMemorandumofUnderstandinginparttohelptheStatemaximizeitsshareofsettlementpaymentstohelpaddressandabateissuesassociatedwiththeopioidcrisis;andWHEREAS,settlementfundswillbeallocatedtosingle-ormulti-countyregionsmadeupoflocalgovernments;andWHEREAS,LarimerCountyhasbeenidentifiedasasingle-countyRegionforthepurposesofsettlementallocations;andWHEREAS,asasignatorytheTownintendstoredirectitsdirectallocationtotheRegion,whichisbettersuitedtodeterminehowfundscouldbestbespenttoaddressandabatetheoploidcrisis.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheBoardapproves,andauthorizestheMayortosign,thememorandumofunderstandingreferencedinthetitleofthisresolution,aswellastheassociatedsettlementparticipationformsandescrowagreement,insubstantiallytheformnowbeforetheBoard.DATEDthis______dayof_________________,2021.
