Donald Pauley Chairman Phares, Commissioners Moss, Pohl, and Ericson Executive Director Anderson, Technical Planner Bob Joseph, Secretary Heifner, Attorney Windholz Commissioners Frantz, Hill and Pauley A special meeting was called by Chairman Phares for the purpose of condemnation of the property at 101 Cleave Street. Attorney Windholz explained the title problem restrictive covenant placed on the property by the Estes Park T°wn Company. The covenant atatea that “ahouia the i^rbe used to traffic in liquor, or to the sale, vending or offering sale of any spirited, fermented or malt liquors thereon ^he qrantees or subsequent successors in title or interest, then this deed shall be null and void". Windholz has recommended this covenant before EPURA takes title to the pjesenti$ covenant might affect future use of the property (lt p^®®eb315one designated by EPURA for downtown public parking). Cost of this condemnation action will be shared equally by EPURA and the Estes Park Bank. Director Anderson will contact the contractor regarding the delay in the startup date of construction.
