HomeMy WebLinkAboutORDINANCE 11-06C ORDINANCE NO.11-06 AN ORDINANCE VACATING A PORTION OF SEVERAL ROADWAYS WITHIN THE TOWN OF ESTES PARK WHEREAS,the owners of property adjacent to portions of Driftwood Avenue, Ponderosa Drive,and Columbine Avenue have requested that the Town vacate a portion of said public roadways;and WHEREAS,the steepness of the portions of the roadways which are requested to be vacated preclude the opening and maintaining of said roadways for public use;and WHEREAS,there is no longer any necessity to have said portion of the roadways remain a part of the Town of Estes Park’s road system;and WHEREAS,vacation of the portion of the roadways will not leave any land adjoining said vacated roadway without an established access to a public road;and WHEREAS,the Board of Trustees has determined that it is in the best interest of the Town to permanently abandon and vacate these portions of roadways as more fully set forth herein. NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO. Section 1:The Board of Trustees of the Town of Estes Park,Colorado hereby vacates these portions of Driftwood Avenue,Ponderosa Drive and Columbine Avenue as the same are more fully set forth on Exhibits A,B and C attached hereto and incorporated hewin by reference. Section 2:The Town surrenders any and all right,title and interest to the vacated portion of the road rght-of-ways. Section 3:This Ordinance shall take effect and be enforced thirty (30)days after its adoption and publication.
