development opposite the Knoll and the traffic study indicates
that, if a development occurs opposite the Knoll, a traffic light
will be necessary.
Commissioner Henderson stated that, if the Knoll is developed and
it is found within a twelve month period that there is not a need
for a traffic light at that location, but within the next twelve
months, the property opposite the Knoll is developed and the
combination of the two projects creates an abundance of traffic,
both developers should share the cost of traffic improvements.
Commissioner Henderson requested the last sentence in item e. of
Resolution 154 be deleted and left open.
Attorney Windholz noted:
1) The reason for a twelve month period was that, at this
time, EPURA may address only the Knoll development and its traffic impact;
2) If the ^ Town adopts EPURA's recommendations and makes
those recommendations a requirement of development, leaving item e.
open would force an unreasonable and therefore, illeoal requirement. ^
Commissioner Godbolt recommended changing item e. to read 24 months.
H°ndius raised concerns regarding the proposed project
and the Urban Renewal Plan directives to (1) provide orderlyqrowth
in the co^unity; (2) address Estes Park's image problem; Yand (3)
