BoardofTrustees—July28,2009—Page3Itwasmovedandseconded(Homeier/Levine)theConsentagendaitemB.1beapprovedwithStaffconditionsofapproval,anditpassedunanimously.3.ACTIONITEMS:1.RESOLUTION#14-09ADOPTINGREDFLAGPOLICY.FinanceOfficerMcFarlandstatedtheUSGovernmentthroughtheFederalTradeCommission(FTC)hasattemptedtoaddressthenationalissueofidentitytheftbymandatingthecreationandadoptionofthe“RedFlag”policies/rules.StaffandAttorneyWhitehavedeterminedtheTownfallsundertheguidelinesassetforthbytheFTCasacreditorandmustcomplythroughthecreationofanidentitytheftprogram.Afterdiscussion,itwasmovedandseconded(Ericson/Blackhurst)toapproveResolution#14-09,anditpassedunanimously.2.2008COMPREHENSIVEANNUALFINANCIALREPORTtCAFR).FinanceOfficerMcFarlandpresentedanoverviewoftheannualfinancialreportingprocess.TheauditingfirmofSwanhorst&Company,LLCconductedanindependentauditoftheTownofEstesPark’sfinancialstatementsasofDecember31,2008andhaveexpressedanunqualifiedopinion(cleanopinion)thatthefinancialstatementspresentedfairly,inallmaterialrespects,thefinancialpositionofthefundsandactivitiesoftheTownofEstesParkinconformitywithGenerallyAcceptedAccountingPrincipals(GAAP).KyleLogan,Swanhorst&Company,LLC,discussedtheCAFRhighlightingthesingleaudit(complianceaudit),adoptionofnewaccountingstandardsrelatedtopostemploymenthealthcarebenefits,andtheneedforaproceduretotrackgrantsandfiletheminacentralizedlocation.TheTownhasreceivedgovernmentgrantsinaccessof$500,000,andtherefore,wasrequitedtocompleteasingleaudit.Theauditidentifiedasignificantadjustmentforproperty(Bob’sAmoco)thatwassoldin2007andnotremovedfromtheTown’saccountingrecords.TheFinanceDepartmenthassuppliedtheauditorswithaCorrectiveActionPlantoaddressthetrackingofgrants.HealsonotedthepostemploymenthealthcarebenefitliabilitywouldincreaseovertimeifitisnotfundedbytheTown;however,fundingtheliabilityisnotrequired.TheauditalsoidentifiedtheFireServicesFundreceivablesofover$31,000andnotedthereappearstobechargesthatareuncollectiblethatshouldbecloselymonitored.Hestatednodifficultieswereencounteredinperformingtheaudit.Itwasmovedandseconded(Ericson/Miller)toapprovetheDecember31,2008CAFRaspresented,anditpassedunanimously.3.TOWNADMINISTRATORREPORT.•TheTownBoardandEPURACommissionwouldholdaspecialjointregularmeetingonMonday,August3,2009at5:00p.m.intheBoardRoom.4.REQUESTTOENTEREXECUTIVESESSION:24-6-402(4)(f),C.R.S.—Fordiscussionofapersonnelmatter;notinvolvinganyspecificemployeeswhohaverequesteddiscussionofthematterinopensession;anymemberoftheTownBoard(orbody);theappointmentofanypersontofillanofficeoftheTownBoard(orbody);orpersonnelpoliciesthatdonotrequirediscussionofmailerspersonaltoparticularemployees.Itwasmovedandseconded(Eisenlauer/Levine)theTownBoardenterintoExecutiveSessionforthediscussionofapersonnelmailer;notinvolvinganyspecificemployeeswhohaverequesteddiscussionofthemailerinopensession;anymemberoftheTownBoard(orbody);theappointmentofanypersontofillanofficeoftheTownBoard(orbody);orpersonnelpoliciesthatdonotrequirediscussionofmailerspersonaltoparticularemployees,underC.R.S.24-6-402(4)(f),anditpassedunanimously. RECORDOFPROCEEDINGSTownBoardStudySession—July28,2009—Page2Mr.Kenneysaidthatthediscussionandinputfromthemeetinghadprovidedsufficientinformationtoprepareaschematicplanthatwillproposesquarefootage,adesignforthebuilding,andastartingpointforcoststopresenttotheTownBoardatthenextstudysession.OPENDISCUSSION.1.TraNs—TownAdministratorHalburntengagedtheTrusteesinadiscussionrelatedtotheconstructionoftrailsintheEstesValley.Atameetingattendedbymembersofthetrailsgroup,EstesValleyRecreationandParkDistrict(EVRPD)Dir.StanGengler,TownAdministratorHalburntandMayorPinkham,twotrailswereidentifiedasprioritiesforconstruction:1.theextensionofFishCreekTrailtotheHomerRousetrail;and2.theextensionofFallRiverTrailtoRockyMountainNationalPark.Athirdtrail,abike/hiketrailintoRockyMountainNationalParkthroughtheoldentrancelocatedinthevicinityoftheDunravenInnonHighway66wasalsodiscussedAdministratorHalburntaskedtheTrusteestheirviewsonpoolingOpenLandsfundswithEVRPDfundstocooperateintrailconstructionsomeofwhichwouldoccuroutsideoftheTownlimitsShesaidthemillevypassedbyEVRPDlastyearisdedicatedtotrailconstructionandthatacombinedeffortwiththeTownmayincreasebuyingpowerandtheabilitytoacquireadditionalfundingTheTrusteesaskedifOpenLandsfundscouldbeusedonthedevelopmentofBondPark.AdministratorHalburntstatedthatFinanceOfficerMcFarlandisresearchingthisquestionandhasnotyetreceivedadefinitiveanswerTheTrusteesrequestedclarificationontheuseofOpenLandsmoniesinBondParkwhichwouldbetlepreferreduseofthefundsandexpressedinterestincontinuedconversationsaboutcooperatingontrailprojects2WorkforceHousingandPlanningfortheFuture—IdeasforthecreationofaffordablehousingfortheEstesParkworkforce,aswellasresidentswerediscussedandincludedrevitalizingthedowntownareaandutilizingunusedspaceaboveretailsshopsashousing,dedicatedsalestaxorpermitfeesforaffordablehousing;andrequiringlargecommercialemployerstoprovidehousingtotheiremployees.TrusteeMillerstatedthatarecentbrainstormingsessionhostedbytheEstesParkHousingAuthorityclearlyillustratedtheneedforhousingandnotedthatiftheproblemisnotaddressedaffordablehousingissueswillcontinuetogrow.MayorPinkhamsaidhehasbeenresearchingtheideaofhiringanoutsideconsultanttohelplookatthebigpicturefortheTownandprovideassistanceinidentifyingtheissuesEstesParkwillfaceinthefutureHesaidscenariodevelopmentandanalysisbyaconsultantmayprovideanswersastohowtheTowncanstimulategrowthtosustainitseconomyandremainadesirableplacetoliveandvacationinthefaceofrisingenergycosts,transportationissues,andalackofaffordableworkforcehousing.Discussionensuedonthefollowingtopics:thehighcostofconsultingfirms;it’sworthwhiletogetsomeonewhoisanexperttoleadandprovideinformationaboutwhatisbeingdoneinotherpartsofthecountryandtheworld;resourcesmaybefoundthroughtheDenverRegionalCouncilofGovernments(DRCOG),theColoradoMunicipalLeague(CML),ColoradoUniversity(CU)orColoradoStateUniversity(CSU),theColoradoAssociationofSkiTowns(CAST),andexpertswithinourowncommunity;consultantsoftenprovideinformationyoualreadyhaveorcangetonyourown;circumstancesoverthelastcoupleofyearshavehadasignificantimpactonlifestylesandpeople’sabilitytoaffordthings;areweatthebeginningofaneweraoflifestyles,whatdoesthatlooklike,andhowarepeoplegoingtospendtheirmoney;thesethingswillhaveasignificantimpactonthiscommunity;whatscenarioswouldcausetheTowntochangeandadapt;inthepastEstesParkcontinuedtogrowindepressedeconomictimes;privateenterpriseandthemarketwillreshapetheTowntomeetfuturescenarios;EstesParkmaybeinabetterpositionthanmountaincommunitieswestofthecontinentaldividedueto RECORDOFPROCEEDINGSTownBoardStudySession—July24,2009—Page2millionwith$500,000/yeartransferredfromtheGeneralFund,$4.3millionwith$770,000/yeartransferredand$6.3millionwith$1.27million/yeartransferred.Ifthedefaultof$500,000istransferredtheCRFwouldincreaseannuallyby$283,000withafundbalanceof$2.1millionin2009.ThisannualincreasecouldbeusedtopaycashforongoingprojectsorleveragedwithCertificatesofParticipation(COPs)toyielduptoanadditional$3.25millionofborrowingpower.TheTowncouldbuildprojectstotalingupto$5.4millionwiththeCOPs.2009YEARTODATEREVIEWI2009FORECAST.FinanceOfficerMcFarlandstatedrevenuesYTDaredown1.4%.TheBuildingDepartmenthasseenasharpdropoffinrevenuesdownfrom$330,000YTDin2008to$80,000YTDin2009.Interestincomeisdownfromstaffsestimateof1.37%to.37%thattranslatesinto$50,000ofunrealizedrevenues.Hestatedstaffidentifiedcapitalprojectsthatarebeinghelduntilthefourthquarterandcouldcovertheshortfallinrevenue.2010POLICYGUIDANCE.AdministratorHalburntreviewedtheCapitalImprovementPlan(CIP)rankingbytheTrustees.ThetoptwoprojectswerethegrandstandsandtheMPEC.Thegrandstandsremainanumberoneprioritybecauseofthesafetyconcerns.ThegrandstandcommitteehasbeenreviewingthedesignwithRogerThorp/Architecttodecreasecosts.ThecommitteewouldbereceivingfinalcostestimatesandTrusteeMilleranticipatesthebasebidof$1.2millionwithaddalternatesthatmaybringtheprojectto$1.3or$1.4million.TrusteeBlackhurststatedconcernswiththeTownfundingaportionofthisprojectandstatedTownfundscouldbeusedtocompleteotherrevenuegeneratingprojectsatthefairgrounds.HestatedtheBoardshouldlookatthepotentialrevenuesoftheprojectsatthefairgroundstodeterminewhattobuildfirst.TheBoarddiscussedoptionsforfinancingtheprojectsandstatedtheywouldliketopayfortheprojectswithavailablefunds;however,theywouldlikestafftobringforwardfinanceoptions.AdministratorHalburntstatedtheonlyotheritemthatreceivedahighratingwasanupdatetotheComprehensivePlan.DiscussionfollowedamongsttheBoardandstaffontheneed,includingthefactanupdatewasrecentlycompletedforthestatisticalnumbersandprojections;anupdateshouldnotbecompletedduringthecurrenteconomicenvironment;themoneyshouldbespentonotherprojects;discussedtheneedtoidentifypotentialcommercialground;moreimportantissuewouldbetoaddresstheinconsistencieswiththeMunicipalCodeandtheEVDC;andaproblemstatedwouldprovideclarityonthescopeoftheissues.MayorPinkhamstatedtheTownneedstolookatthelongtermsustainabilityofthetownandtheissuesfacingthecommunity.HeinformedtheBoardthatRMNPSuperintendentBakerhasshowninterestinanassessmentandmaybeabletoprovidefundingofapproximately$30,000.TheBoardreachedconsensustoremovetheComprehensivePlanupdatefor2010.ChiefDormanstatedaninspectionofTownHallwascompletedandareportwouldbeforthcoming;however,nomajorissueswerefound.IftheFireDistrictpassesinNovember,theissueofafirecodecouldbeaddressedbythedistrict.TheBoardagreedtheadoptionofaFireCodeshouldbeplacedonholduntilaftertheelection.TheBoardrequestedadditionalinformationonthecost,location,andsize(numberofspaces)forapolicecarport.Thecarportwouldprotectthecarsfromsundamagetothepaintbutmoreimportantlytheelectricalcomponentswithinthecarsandwouldkeepthecarsfreefromsnow.TheTownreceivedgrantfundingforthebeautificationofMoraineAvenue.CDOThasinformedPublicWorksthatthestateexpectstheTowntofixthepedestriancrossingwitha$100,000trafficlight.DiscussionfollowedontheneedforthecrossingatMoraineAve.toWiest.TheBoardreachedconsensusontheremovalofthepedestriancrossingatanestimatedcostof$5,000.
