BoardofTrustees—April28,2009—Page4DiscussionfollowedamongsttheBoardandhasbeensummarized:ADU5canbecontrolledthroughdeedrestrictionsorcovenants;questionedwhetheranexistingADUcouldberemodeled;thenewregulationswouldpenalizetheexistingADU5orthosepropertiesthatcurrentlyhavetheabilityofanADUwithoutalltherestrictions;theADUrequirementsaremorestringentthanthecurrentrequirementsforasingle-familyhome,i.e.landscapingaparkingspotorexteriorlighting;detachedunitsshouldbeanoption;off-streetparkinglanguageisredundantandunclear;proposedregulationsthataddresseddetachedunitsarestillincludedandwouldbeonerousforanattachedunit;anumberofADUs(attachedanddetached)existinthevalleyanditremainunclearhowtheseunitswillbehandledinthefuture,i.e.redevelopmentorexpansionoftheunits;thereisnoenforcementmechanism;theComprehensivePlanencouragesrentalunitsandhighdensitydevelopment;andrentalofADU5shouldbeallowed.TrusteeBlackhurstexpressedconcernthattheTownisaddressingasmallproblemwithonlyapproximatelysixrequestsayearandtheissuehasbeenoverstated.PlannerShirkstatedthePlanningCommissionhasstatedtherentalofADU5wouldbeaddressedatalaterdateinanefforttostudyallhousingissuesinthevalleybeforebringingforwardarecommendation.PublicComment:ThosespeakinginsupportofADUs:BettyNickel/Countyresident,DavidHabecker/Towncitizen,RitaKurelja/EPHADirector,PeterPlaut/Countyresident,EricWaplesforMiltGarrett/Towncitizen,SteveNickel/CountyresidentandMatthewHeiser/Towncitizen.Landownersshouldbeabletousetheirpropertywithasfewrestrictionsaspossible;however,theunitsshouldnotbeusedforshort-termrentals.TheproposedcodeaddressesADUsasanaccessoryuse,andtherefore,competeswithgarages.f.whichisconsideredaccessory.Thevalleyisinneedofadditionalhousingunits;thereforeADUsshouldbeavailableforrent.Ms.KureljastateditisdifficulttoaddressADU5andnotaddresstherentaloftheunitsatthesametime.ADU5couldbearesourceforseasonalhousingduringthetouristseason,increasesupplyofaffordablehousingwithlittletononewinfrastructureandincreasepropertytaxes.Detachedunitsshouldbeconsideredforlotsthatcanbesubdivided.JoannaDardenspokeinoppositionofADU5.SheexpressedconcernwithgrowthinthevalleyandstatedADUsarenottheanswertothehousingneedsofEstesPark.Highdensitydevelopmentwouldhaveanegativeimpactonwildlife.DaveSchultz/Towncitizenstatedpubliccommentshouldbeacceptedontheissueofdetachedunitsandrentals.Heexpressedconcernwiththemanysub-issuesthatarisewiththerentalofADUs.JohnSpooner/CountyresidentstatedtheADUregulationsshouldnotbeapprovedwithoutaddressingtheissueofdetachedunitsandrentals. BoardofTrusteeApril28,2009—Page2entireprojectorseparatepartsoftheproject.TownAdministratorHalburntstatedthatstaffisworkingonareportthatwillsummarizeimprovements,includingutilityanddrainageimprovements,thathavebeencompletedatthefairgroundstodate.SheaskedtheTrusteesandCommissionersfortheirthoughtsontheproposedarchitectural/designguidelinesandthegroupconcurredthatthematerialsandcolorswerepleasingandbroadenoughtoallowforcreativityofdesignandcohesivenessthroughouttheproject.WhereuponMayorProTemLevineadjournedthemeetingat6:40p.m.CynthiaDeats,DeputyTownClerk0/0
