Attending:Chairman Dannels;Members Harry Tregent,N.T.Petrocine, Rollen Sutter,and Ed Palmer. Also Attending:Town Clerk Dale G.Hill and Building Inspector W.Ted Hackett. Mrs.Hildred Griffith appeared before the Board of Adjustment and asked for a zoning variance in a portion of Block 10,Estes Park,Colorado.Mrs. Griffith submitted surveys of the proposed variances which are attached to and made a part of these minutes.The surveys are labeled Parcel 1,2, and 3.The three properties involved do not meet the zoning requirements for total lot area or side and front yard setbacks.Mr.Donald Engelhardt spoke opposing the surveys as submitted by Mrs.Griffith.Mr.Engelhardt suggested the survey of Parcel No.3 adjoining his property is in error as to the location of the south boundary.After considerable discussion, Board member Tregent introduced the following resolution and moved that it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BOARD OF ADJUST NENT OF THE TOWN OF ESTES PARK,COLORADO: That the variances dividing the three parcels in a portion of Lot 15,Block 10,Town of Estes Park,Colorado,according to the Second Amended Plat thereof,described as follows: Parcel No.1 beginning at a point on the West line of said Lot 15,at a point 243.7 feet north of the South West corner thereof, thence East 90.0 feet,thence North 633 feet to the South line of Vir ginia Drive,thence N 75°38’W along said South line a distance of 92.9 feet,said point being the North West corner of Lot 15,thence South 86.3 feet to the point of beginning.The East 15 feet thereof reserved for easement; Parcel No.2 beginning at a point on West line of said Lot 15, at a point 207.7 feet north of South-West corner thereof,thence East 90.0 feet, thence North 36.0 feet,thence West 90.0 feet,thence South 36.0 feet to the point of beginning.The east 15 feet thereof reserved for easement; Parcel No.3 beginning at a point on West line of said Lot 15 at a point 150 feet North of South-West corner thereof,thence East 90.0 feet,thence North 57.7 feet,thence West 90.0 feet,thence South 57.7 feet to the point of beginning; are granted to the existing structures only and no addition or reconstruction of the structures shall be permitted under this variance.Member Dannels seconded the motion.Upon roll call the motion passed by the following votes:Member Dannels-Ye&’,Member Tregent-”Yes”,Member Petrocine-”No”, Member Sutter-”Yes”,Member Palmer-”No”. ccERNESTG.HARTWELLATTORNEYATLAW211-7thStreetPhone667-3126—P.0.Box5Loveland,Colorado-80537March18,1966Mr.DaleG.HillTownClerkP.0.Box1200EstesPark,ColoradoDearMr.Hill:IamwritinginresponsetoyourrequestformyopinionastotheproceduretobefollowedbythepropertyownersandtheBoardofAdjustmentinregardtotheBuildingInspector’srefusaltoissueasignpermittotheownersofpropertyinLonePineAddition.Thepropertyowners,iftheydonotwishtoabidebythedecisionoftheBuildingInspectorrelativetotheirapplicationforasignpermit,canappealtotheBoardofAdjustmentforareviewofthedecisionoftheBuildingInspectorasprovidedinSection12.16oftheMunicipalCodeandChapter139-60-7,C.R.S.1963.TheappealmustbetakenwithinthetimeprovidedbythegeneralrulesoftheBoardofAdjustmentforfilingappealsandinthemannerasprescribedbysub-paragraph(2)of139-60-7,whichprovidesforawrittennotice,specifyingthegroundsfortheappeal,beingfiledwiththeofficerfromwhomtheappealistakenandwiththeBoardofAdjustment.TheBoardthenshallfixareasonabletimeforthehearing,givingduenoticetothepartiesanddecidethesamewithinareasonabletime.TheBoardofAdjustmentmayreverseoraffirmwhollyorpartly,ormaymodifythedecisionappealedfromandshallmakesuchorderandrequirement,decisionordeterminationasinitsopinionoughttobemadeinthepremises,andtothatendshallhaveallofthepowersoftheofficerfromwhomtheappealistaken.WheretherearepracticaldifficultiesorunnecessaryhardshipsinthewayofcarryingoutthestrictletteroftheCode,theBoardofAdjustmentshallhavethepowerinpassinguponappeals,tovaryormodifytheapplicationoftheregulationsorprovisionsoftheCoderelatingtotheuse,constructionofthestructureortheuseofthelandsothatthespiritoftheCodeshallbeobserved,publicsafetyandwelfaresecuredandsubstantialjusticedone. 00cQMr.DaleG.HillMarch18,1966Page2TheBoardshoulddeterminethattheCode,asappliedinthiscase,doesnotproduceanarbitraryandoppressiveresult.ThepurposeoftheBoardofAdjustmentisnottoprovideforsubstantialchangesinzoningfornon-conforminguseswhichresultinavirtualrezoningofcertainpropertytherein;but,rather,topermitminordeparturesfromtheliteraltermsoftheCodewhenjusticesorequires.ThepurposeoftheBoardofAdjustmentistopermitanameliorationoftherigorsofnecessarilygeneralzoningregulationsbyeliminatingthenecessityforslavishadherencetothepreciseletteroftheregulationswhere,inagivencase,littleornogoodononesideandunduehardshipontheotherwouldresultfromaliteralenforcementoftheCode.TheBoardcannotdisregardtheprovisionsoftheCode.Itcanmerelyvarythemtopreventaninjusticewhenthestrictletteroftheprovisionswouldworkunnecessaryhardship.TheBoardofAdjustmenthasjurisdictiontoheartheappealandtomaketheexceptionifitdeterminessuchanexceptiontobenecessaryintheinterestofcarryingoutthespiritoftheprovisionsofChapter12oftheCodeandinthefurtheranceofsubstantialjustice.VariancesaregrantedtopreventinjusticeswhenthestrictletteroftheCodewouldworkanunnecessaryhardship.TheBoardshouldnotsearchforareasontograntthevariance,butattempttodeterminethatthedecisionastothispermitcarriesoutthespiritandintentoftheChapterbutdoesnotworkanunnecessaryhardshipuponthepropertyowner.TheBoardshouldreceiveallevidence,bothfromthepublicofficialfromwhosedecisiontheappealismadeandfromthepropertyownerswhoareappealingthedecision.Thepropertyownersmayappearinpersonorbyattorey.trulyyours,‘:ErnestG.HartwellEGH:jjcc:BuildingInspectorBoardofAdjustment Cfl139-60-7.BoardofAdjustment.--(1)Suchlegislativebodyshallprovidefortheappointmentofaboardofadjustmentconsistingoffivemembers,eachtobeappointedforthreeyears.Suchboardofadjustmentshallhearanddecideappealsfromandreviewanyorder,requirement,decision,ordeterminationmadebyanyadministrativeofficialchargedwiththeenforcementofanyordinanceadoptedpursuanttothisarticle.Itshallalsohearanddecideallmattersreferredtoitoruponwhichitisrequiredtopassundersuchordinance.Theconcurringvoteoffourmembersoftheboardshallbenecessarytoreverseanyorder,requirement,decisionordeterminationofanysuchadministrativeofficial,ortodecideinfavoroftheapplicantanymatteruponwhichitisrequiredtopassunderanysuchordinanceortoeffectanyvariationinsuchordinance.Everydecisionofsuchboardshall,however,besubjecttoreviewbycertiorari.Suchappealmaybetakenbyanypersonaggrievedorbyanofficer,department,boardorbureauofthemunicipality.(2)Suchappealshallbetakenwithinsuchtimeasshallbeprescribedbytheboardofadjustmentbygeneralrule,byfilingwiththeofficerfromwhomtheappealistakenwiththeboardofadjustmentanoticeofappeal,specifyingthegroundsthereof.Theofficerfromwhomtheappealistakenshallforthwithtransmittotheboardallthepapersconstitutingtherecorduponwhichtheactionappealedfromwastaken.(3)Anappealstaysallproceedingsinfurtheranceoftheactionappealedfrom,unlesstheofficerfromwhomtheappealistakencertifiestotheboardofadjustmentafterthenoticeofappealshallhavebeenfiledwithhimthatbyreasonoffactsstatedinthecertificateastaywould,inhisopinion,causeimminentperiltolifeorproperty,inwhichcaseproceedingsshallnotbestayedotherwisethanbyarestrainingorderwhichmaybegrantedbytheboardofadjustmentorbyacourtofrecordonapplication,onnoticetotheofficerfromwhomtheappealistakenandonduecauseshown.(4)Theboardofadjustmentshallfixareasonabletimeforthehearingoftheappealandgiveduenoticethereoftotheparties,anddecidethesamewithinareasonabletime.Uponhearing,anypartymayappearinpersonorbyagentorbyattorney.Theboardofadjustmentmayreverseoraffirmwhollyorpartly,ormaymodifytheorder,requirement,decisionordeterminationappealedfromandshallmakesuchorder,requirement,decisionordeterminationasinitsopinionoughttobemadeinthepremises,andtothatendshallhaveallthepowersoftheofficerfromwhomtheappealistaken.Wheretherearepracticaldifficultiesorunnecessaryhardshipsinthewayofcarryingoutthestrictletterofsuchordinance,theboardofadjustmentshallhavethepowerinpassinguponappeals,tovaryormodifytheapplicationoftheregulationsorprovisionsofsuchordinancerelatingtotheuse,constructionoralterationofbuildingsorstructures,ortheuseofland,sothatthespiritoftheordinanceshallbeobserved,publicsafetyandwelfaresecuredandsubstantialjusticedone.
