Member Garrett moved that the first part of this variance
request regarding expansion of a nonconforming use be
granted. Member Barker seconded the motion and it passed
unanimously. Chairman Habecker abstained.
After further discussion regarding proposed parking spaces,
Member Barker moved that the variance from the minimum
number of required parking spaces be granted. Member
Garrett seconded the motion and the vote was unanimous.
Chairman Habecker abstained.
REPORTS
In an effort to clarify the "conflict of interest" question
with board members, member Sager requested an opinion from
Town Attorney White as to whether or not a member having a
conflict of interest should be required to leave the room
during discussion and voting. Attorney White stated that it
IS purely a member's personal choice as to whether or not he
wants to absent himself from the room. At a public meetina
anyone has the right to be present.
