Member Wagner moved that in the absence of Chairman Sutter, Member
Prosser be named Acting Chairman and that Alternate Member Sager
act as a Member of the Board. Member Palmer seconded the motion,
xponroll call the motion unanimously carried.
Dr. James A Durward appeared before the Board of Adjustment and
requested a variance from the off-street parking requirements as
contained in the Municipal Code, Section 17.64. The property
involved in this request is lots 25, 26, 27 and the West 19*2
feet of Lot 24, Block 3, Town of Estes Park.
Dr. Durward presented his case to the Board and explained the
reasons he was requesting the variance.
After considerable discussion. Member Sager moved the variance
request be denied. There being no second to the motion. Chairman
Prosser declared the motion dead.
After further discussion. Member Wagner moved that Dr. Durward be
granted a variance in the amount of twelve (12) off-street parking
places. Member Palmer seconded the motion. Upon roll call the
following vote was recorded.
Member Wagner Yes
Member Palmer Yes
Member Herzog Yes
Member Sager No
Member Prosser No
The Colorado State law requires the concurring vote of four
members of the Board. Chairman Prosser declared the request for
a variance denied.
There being no further business, the meeti ned.
