HomeMy WebLinkAboutORDINANCE 06-99cCORDINANCENO.6-99Q0ANORDINANCEVACATINGRIGHT-OF-WAYFORLAYINGANDMAINTAININGWATERANDSEWERLINESEASEMENTWHEREAS,theownerofpropertysubjecttotheright-of-wayforlayingandmaintainingwaterandsewerlineseasementshasrequestedthattheTownvacatetheright-of-wayforlayingandmaintainingwaterandsewerlineseasementsastheownershavegrantedanewright-of-wayforlayingandmaintainingwaterandsewerlineseasements;andWHEREAS,thereisnolongeranynecessitytohavetheright-of-wayforlayingandmaintainingwaterandsewerlineseasementsproposedtobevacated;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisinthebestinterestsoftheTowntopermanentlyabandonandvacatetheseright-of-wayforlayingandmaintainingwaterandsewerlineseasements.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1:TheBoardofTrusteesoftheTownofEstesPark,Coloradoherebyvacatestheright-of-wayforlayingandmaintainingwaterandsewerlineseasementsasfollows:RightofwayforlayingandmaintainingwaterandsewerlineswasgrantedtotheTownofEstesParkbyrecordedplatofWhiteMeadowViewPlaceadditiontotheTownofEstesParkbyinstrumentrecordedJune10,1938inPlatBook5andpage33,LarimerCounty,Coloradoinwhichthespecificlocationoftheeasementisnotdefined.Section2:TheTownsurrendersanyandallright,titleandinteresttothevacatedright-of-wayforlayingandmaintainingwaterandsewerlineseasements.Section3:Theadoptionofthisordinanceisherebydeterminedtobedeclaredanemergencyduetothefactthatitisnecessarytoimmediatelyvacatetheright-of-way;andWHEREAS,intheopinionoftheBoardofTrusteesanemergencyexists,thisordinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.ATTEST:TownClerk,PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHISo5%AYOFAlca/,1999.TO
