00ORDINANCENO.5-99ANORDINANCEADOPTING,BYREFERENCE,THENATIONALELECTRICCODE,1999EDITIONWHEREAS,theBoardofTrusteesoftheTownofEstesPark,ColoradohasdeterminedthatitisinthebestinterestoftheTowntoadopttheNationalElectricCode,1999Edition.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.Section14.20oftheMunicipalCodeisherebyadoptedasfollows:14.20.010NationalElectricCode,1999,Adopted.TheNationalElectricCode,1999Edition,issuedbytheNationalFireProtectionAssociation,Inc.,BafterymarchPark,Quincy,MA02269,isenactedandadoptedbyreferenceasaprimarycodeandincorporatedinthischapter.14.20.015NationalElectricCode,1999—Violation.A.ItisunlawfulforanypersontoviolateanyoftheprovisionsstatedoradoptedintheNationalElectricCode,1999Edition.B.EverypersonconvictedofaviolationofanyprovisionstatedoradoptedintheNationalElectricCode,1999Edition,shallbepunishedassetforthinSection1.20.020oftheMunicipalCode.14.20.017Damages.NeithertheTown’sBuildingInspector,TownEngineer,LightandPowerDirector,noranyotheremployeeoragentoftheTownofEstesPark,noranyvolunteeractingonbehalfoftheTown,shallbeliableforanydamagesforanyactand/oromissionbysuchperson,pursuanttothedutiesandenforcementoftheprovisionsoftheNationalElectricCode,1999Edition.14.20.020License—Required.Itisunlawfulforanypersontoengageinthebusinessofinstallation,alteringorrepairingelectricalwiringintheTownwithoutfirsthavingprocuredalicensethereforefromtheState.Therequirementforalicenseshallnotapplytotheownerofanypropertydoingworkinorabouthisownresidence,providedthathefirstobtainsthenecessarypermitthereforTherequirementforalicenseshallnotapplytoajoumeymanelectricianorhelperwhoisworkingunderthecontrolandsupervisionofanelectricianlicensedbytheState.14.20.040Permit—Application—Issuance.ApplicationforpermitshallbemadetotheColoradoStateElectricalBoard.Suchpermitshallbepostedonthesiteofthework,andkeptthereuntiltheworkiscompleted. C014.20.060Certificateofapprovalrequired.ItisunlawfulforanypersontomakeanyelectricalconnectiontoanybuildinguntiltheStateElectricalInspectorhasissuedacertificateapprovingtheelectricalwiring.14.20.070Permit—Temporary.Where,fromgoodandsufficientcause,itisnecessarytohaveelectricityonanyinstallationbeforethefinalcertificatecanbeissued,theStateElectricalInspectormayissueatemporarypermit;provided,thatallpartstowhichcurrentisappliedareinasafeandsatisfactorycondition.14.20.080Electricalconstructionrequirements.Allnewstructuresandexistingstructuresthatarealtered,addedtoorrepairedinexcessoffiftypercent(50%),andwhichcontain,inwholeorinpart,commercialuses,shallbeentirelywiredinrigidorsteeltubeconduitsorapprovedmetalraceways.UnlessitisotherwiserequiredbyapplicableprovisionsoftheNationalElectricCode,1999Edition,therequirementsofthissectiondonotapplytoafreestandingcommercialstructureservedbyoneelectricmeterlocatedintheTown’scommercialoutlying(CO)zone.Section2.TheadoptionofthisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNESTESPARK,COLORADO,THISj{t1xDAYOFAt0J4,1999.UOFTOWNOF’ESTESPARK,COLORADOByMayor‘C,—‘51$S.IherebycertifythattheaboveordinducedandreadatameetingoftheBoardofTrusteesontheUtldayofAka.,1999,andpublishedinanewspaperofgeneralpublicationintheTownofEstesPark,Colorado,onthef4thdayof________,1999.\pva/TownClerk,bepjATtEST:
