RESOLUTION41-21APPROVINGTHETHIRDAMENDMENTTOTHEINTERGOVERNMENTALAGREEMENTFORWASTEWATERTREATMENTBETWEENTHETOWNOFESTESPARKANDTHEUPPERTHOMPSONSANITATIONDISTRICTWHEREAS,theTownBoardwishestoamendtheagreementreferencedinthetitleofthisresolutionforthepurposeoftransferringwastewatercapacityfromtheabandonedProspectMountainPlanttotheMary’sLakeWaterTreatmentPlant;andWHEREAS,thisagreementwasoriginallyexecutedin2009,andwasamendedin2013,andsubsequentlyin2015.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheBoardapproves,andauthorizestheMayortosign,theThirdAmendmenttotheagreementreferencedinthetitleofthisresolutioninsubstantiallytheformnowbeforetheBoard.DATEDthisi6dayofATTEST:APPROVEDASTOFORM:.2021.TOWNOFESTESPARKClerkTownAttorney
