AN ORDINANCE ADOPTING A PLAI’FOR THE ACQUISITION
OF AN EIFCTRI(AL DISTRIBUTION SYETEM TO BE OWNED
AND OPERATED BY THE TOWN OF ESTES PARK;PPOVID
ING FOR AN ELECTION AT ICIT THE QUESTION OF
APPROVING THIS ORDINANCE SHALL BE SUBHITTFfl TO A
VOTE OF THE çUALIFIED PPOPERTY ELECTORS CF THE
TOJ!:OF ESTES PARK AS SHALL IN ThE NEXT YER
PEECEDINC THE YEAR OF ELECTION HAVE PAID A
PRCPERTY TAX THEREIN;AND DECLARING AN EHERCrENCY
1JHFPEAS,the Board of Trustees of the Town of Estes
Park,in the Count of Larimer and State of Colorado,ha
determined and does herebr determine forthwith to acquire,
operate,and ma±ntain a municipal electric light and power
system for the Town of Estes Park;
NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE TOWN OF ESTES PARK:
Section 1.That the Town of Estes Park acquire an
electrical distribution system (said electrical distribution
system to be acquired in thc manner hereinafter set forth in
SectIon 2 of this ordinance)to be owned,managed and operated
by sa Town and to consist of poles,wires,insulators,trans
formers,meters,drops,and all the usual components of an
electrical distribution system.
Section 2.That the Town of Estes Park shall acquire
by purchase or condemnation the present electrical distrIbution
system owned by the Public Service Conmany of Colorado and
serv.ng the Town of Estes Park and its inhabitants;provided
such acquisition can be accomplished at a price satisfactory to
the Bord of Trustees,
Section 3.The property to be acnuired for such
municipal electric light and power system is as follows:the
present e)ectrical d4stribution system of the Public Service

Com?any of Colorado now servrc the To’:n of Estes Park and its
inhabitants,consisting of poles,wires,insulators,trans
formers,meters,drops,and all the usual components of an
electrical distribution system.
Section 4.That the full purchase price to b oaid
by said Town in a cnuiring said electri.cal distribution system
is not to exceed the suii of 95,000.00.Such prIce will be paid by
issuing municipal interest—bearing obligations for such amount,
payable,interest and principal,solely out of the income of
such utility;and the oblIgation of said bonds shall he charge
able solely against the income of such utility.No obligation
by way of general obligation bonds shall be incurred by the
Town of stes Park in making such accuisition.
Secton 5.That a special election is hereby called
and shall be held in said on on the 7th day of September,1943
at which time there shall be submitted to such qualified property
electors of said Town as shall in the next year preced4ng the
year of the election have paid a property tax therein,the
question of ap’roving this ordinance.
Section 6.That the qvestion so su.h’iItted shall be
voted on at said election by the voters qualified as aforesaid
at the follov;ing polling place in said Town:

The vote shall be by ballot of the form hereinafter provided,
and said election shall be held and conducted in all respects
as nearly as may be in the manner nrescribed by lw in cases
of elections for municipal officers.
Section 7.That the ballots to be used in voting
upon the question above s’ibmltted shall be prepared and fur
nished by the Town Cerk and Recorder to the judges of election,
to be by them furnished to the voters,shall be substantially
in the following printed form,and shall be deposited in a
ballot box provided by the Town Clerk and Pecorder for such
purpose.
