There is hereby created and established a ‘Jater DepcLrtrnent of the Town of i.stes park for the purnose of the management,maintenance, care and operation of the water works of said Town. ction 2.Superintendent,i?owers ad Duties. There is hereby created the office of Superintendent of Water orks •and said unerintendent shall be appointed and his salary shall be fixed ‘ey the Board of Trustees of the Town of stes 2irk, and said 3uerintendent shall hold office for such time as the Board of Trustees sees fit. The 3uperintendent of the ‘Jater ‘Jorks shall have the immediate control and management of all thinja pertaining to the Tov:n’ater iorkc jstem,and he shall perform all acts that may be necessr for the prudent,efficient and economical ma;iacement an protection of said water works,sibject to the apfJroval and confirmation of the Board of Trustees.He shall furnish bond in the sum of One housaiid Dollars (.l,OOL.OO)for the faithful performance of his offic and to turn over all funds collected to the Town Treasurer -r •- —1— as often as the Board of Trustees shall require,and in any event,once a month.The Town shall pay the premium on sui. bond.The Board of Trustees shall have power by motion to prescribe such other and further rules and regulations governing the power and duties of the Superintendent and the management of said Water WOrks Department and such other rates,rules and regulations as are not herein contained. Section a.Receipts and Deposits. The Water Superintendent shall keep a correct account of all receipts,inae out all bills for water rents and materials furnishe to consumers,collect the same and deposit the proceeds so collected with the Town Treasurer to the credit of the Water Wors B’und of said Town,and in accordance with the direction of the Board of Trustees of saiu Town. Section 4.Inspection. Whenever,in the juugment of the Superintendent,he deems it necessary,he may inspect the premises of any consumer for the purpose of examining the conuition of all pipes,motor,meters and water fixtures.He shall be vigilant to protect and reaedy all abuses whether from waste or other improper use of water. Section 5.Rules and Regulations Governing Water Rates and Privileges and Penalties Thereunder. The following rules and regulations are hereby established for the management,control anu protection of the Town Water Works. Saii rules shall be considered a part of the contract with every —2- C ,.,j :‘ person taäng water supplied by the town from its water works,and every person taLing water shall be considered as having expressed consent to be bound thereby. RULE 1. Applications for the use of water shall be made to the iater Superintendent at his office.The application must be made by the owner or agent of the property to be benefitted,designating the location of the property and stating the purpose for which the water may be required. RW 2. At the time of macing application for new tap anu service connection,the Superintendent shall collect the sum of Ten Doliars(1O.OO)to cover the cost of the corporation cock, expansion joint,curb box and tapping saddle.All necessary pipe,fittings,valves,shut off,trenching,back filling and installation of the tap must be at the expense of the applicant anu under the supervision of the mater âuperintendent.Tapping must be done by a liscensed plumber,and a standard corporation cock and expansion joint,furnisheu by the town,must be used. RULE . It is required that each service tap shall not be more than five—eighths (5/8)inches in diameter unless special permission is given for a bigger tap,and all plumbing through which water is used shall be installed by a licensed plumber. RUlE 4. Should the owner or the occupant of the premises desire -3- —r ! macie for the expense of turning it off and on,tu be collected as other rates are collected. RULE 8. Two or more premises cannot be suppliea from one and the same connection unless provided with separate shut—off cocks,located in the street. RULE 9. No consumer shall be permittea to conduct water pipes across lots or buula.iugs to ajoining premises without the permission of the 3uperintendent. The Town shall not be responsible for the service pipes and fixtures.1l owners,at their own expense,must keep service pipes from the town main and all their apparatus in good working order “. and properly protected from frost and other disturbances.No claim shall oe made against the Town on account of the 5reaing of service pipes or apparatus or for failure in the supply of water.No reduction in the regular rates will be inde for any time that service pipes or fixtures may be frozen. No occupant or owner of any build inr into which water is introduced will be allowed to supply water to other persons or faailies.The water departient agrees to furnish water for a certain specified sum.If,therefore,consuners furnish other people or zup)ly water for animals or for spri;ikliig,washing vehicles or for building purposes,or permit it to be taen withoit the knowleuge or consent of the water department,it is a viol2tion of contract,and consumers so offending ‘jill be reqjlired to pa:T doule the price of water so used,and the town reserves the ri’ht to shut off the supply for abuses of water privileges.hen the water has been turned off for violation of the Rules,the water deijartmet will withhold it until ‘ill dues and penalties have been paid,inc1ding the further sum of fifty cents for turning the water off. ? ,r? runnin for any purpose other than the use intended,and for any uimecessarv waste of the right to cut off the supply and assess Dollars (.5.OO)which shall be paid before &a in. —6— 4PV ‘V RUlE 17. In case there shall be any water rent delinquent and the supply has been turned off,the water shall not be turned on again until all such delinquent water ‘ents have been paid. RUlE 18. The Town reserves the right upon reason&ole notice to shut off its mains for the purpose of makin repairs,or e eiisions,or any other purpose,anft no claim shall be made against the town by reason of the breakage of any service pipe or service cock or from any other damage that may recult from shutting off water for repairing and relaying mains,hydrants or other connections. RUlE 19. No deductions will be made from the rates on account of any of the fixtures not being used.If they are not in use and not wanted,the owner should have a plumber disconnect them and serve written notice on the Superintendent,and the charge for their use will cease. RUlE 20. fee of fifty cents will be charged in all cases for turning on water into the premises for the first time after water service is established therein,or in case Iremises are vacated and the water has been turned off by the water department for its own protection or in case the water has been turned off because of a brea in the service connection or pipes.In case of any repair made necessari by freezing,the expense of repairing shall be paid by consumer in addition to the fifty cents fee above provided for. RUlE 21. RULi 24. he uperintendeiit or other officers of the town shall be permitted at all times to enter the premises or buildings of consumers to examine the water pipes and fixtures and te manner —8— - - in which the water is used,and in case of fraudulent representation on the part of the consumer or wilful or unreasonable waste of water, said consumer shall forfeit any payment made and the water depart 1nent may cause the water to be turned off and assess the damages to the premises. RU’5. The Superintendent of the Jater orks shall have power subject to approval by the Board of Trustees to make and enforce such other rules and regulations overninp:service,tap connections,plumbing requirements and regulations as are not herein provided.It is pecifica1ly provided that all plumbing and plumbing fixtures, wherever used,shall be of standard make and construction and shall be installed in the first instance by a licensed plumber,and any plumber altering,changing or addig to any plumbing shall immediately report the same to the Water Superintendent and his failure so to do shall suoject him to revocation of his license and a fine not to exceed Twenty—five Dollars (25.00). RULE 26. In each and every violation of the rules and reaulations r..establishea by this Ordinance,the offending party shall be subject to a fine of not less than d’ive Dollars (.5.O0)nor more than Fifty Dollars (5O.00),unless otherwise provided herein.
