HomeMy WebLinkAboutORDINANCE 29-1924ORDINANCE NO.29 ORDINANCE PROVIDING FOR THE INSPECTION OF PRENISESBYTHEFIREDEPARTPNTTOSAFEGUAPDTHEiU3LICANDPROPERTYAGAINST FIRE. BE IT ORDAINED BY ‘HE BOARD OF TRUSTEE3 OF THE TO’T OF ESTES PARK,CCI CRADO. SECTION 1.It shall be the duty of the Chief of the Fire department to inspectorcausetobeinspectedbyfiredepartmentofficersormembers,as often asmaybenecessary,hut not less than twice a year in outlying districts and four timesayearinthecloselybuiltportionsofthecity,all buildings,premises and publicthoroughfares,except the interiors of private dwellings,for the purpose of ascertainingandcausingtobecorrectedanyconditiorsliabletocausefire,or any violations oftheprovisionsorintentofanyordinanceofthecityaffectingthefirehazard. Whenever any officer or member shall find in any building,or upon any premisesorotherplace,combustible or e:plosive matter or dangerous accumulation of rubbishorunnecessaryaccumulationofv:aste paper,bores,shavings or any other highly inf lam— ma.ble materials expecially liable to fire,and which is so situated as to endanger prop erty,or shall find obstructions to or on fire escapes,stairs,passageways,doors orwindows,liable to interfere itii the operations of the fire department,or egress ofocupants,in case of fire,he shall order the same to be removed or remedied,and suchordershallforthv:ith be complied with by the owner or occupant of such premises orbuildings1subjecttoappealwithin24hourstotheMayor,who shall within 10 days re—view such order and file his decision thereon,and unless the order is reveked or modifieditshallremaininfullforceandbeobeyedbysuchowneroroccupant. Any owner or occupant failinE to comply with such order within 10 days after said appeal shall have been determined,or if no appeal is taken,then within 10 days aftertheserviceofthesaidorder,shall be liable to a penalty as hereinafter stated. The service of any such order shall be made upon the occupant of the remises towhomitisdirectedbyeitherdeliveringatruecopyofsametosuchoccupantperaonally or by delivering the same to and leaving it with any person in charge of the premises,or in case no such person is found upon the premises by affixing a coty thereof in a con spicuous place on the door to the entrance of the said premises.‘Thenever it may be nec essary to serve such an order upon the owner of the premises,3uCh order may be servedeitherbydeliveringtoandleavingwiththesaidpersonatruecopyofthesaidorder,or,if such owner is absent from the jurisdiction of the officer making the order,bymailingsuchcopytotheowner’s last known post office address. SECTION 2.Any person or persons,firm or corporation,violating any of the iwo— visions of this ordinance or any of its sections,shall,upon conviction,forfeit and pay a fine of not more than 25.00 for every day thereafter so long as the said viola tion exists,and a fine of not more than l00.0O for subsequent violations.
