Transportation Company,a.corporation,intends to apply to the

PARK,COLORADO.
Section 1.There is hereby granted to The Rocky
Pountain Parks Transportation Comoany,a cornoration,its suc
cessors and asigns,for the cniod of five years from and after
the date of the Iassasc of this ordinance,the right and privilege
of rulminr and operating its automobiles,trucks and other like
vehicles,used by it in its business of transpcrting passengers,
c.il,express and freight in tile Tonn of Pates Park over and
along all of the streets and alleys thereof.
Section 2.The said con any at all tines durIng the
life of this franchise shall be subject to all lawful o::crcise
of the polIce power by the town,a;ii to such reasonable regula—
tiuns as the town nay by ordinance or resolution hereafter pro
vide.
Section 5.Before entering upon the enjoenent of the
ri’hts,‘ivilcges and franchises herein granted the said con—

and to be filed with the Town Clerk,conditioned that the said
company shall save the town harmless from all loss custai;:ed by
the town on account of any suit,judgment,execution,claim or
demand whatsoever resulting from negligence on the nart of the
said company in running and operating its automobiles,trucks
and like vehicles in the Town of stes Park.The said tovn shall
notify the,said company’s representatives in said town within
five days after the presentation of ay claim or demand,either
by suit or otherwise,dc against the town on account of any

such negligence as aforesaid on the part of the said company.
Sect ion 4.During the life of this franchise the
said company shall keep and maintain its equipment and service
strict1-1io&ern id efficient in every way.
Section 5.The right and rrivilege hereby ‘anted
is upon the exr ess condition that the said The Rocky iountain
Parks Transportation Company,its successors and assigns,shall
pay to the Town o’istes ark,in consideration of the right
and orivilege hereby granted,the supi of three hundred (;,;300)

hereby granted.
Section 6.It is agreed in tile evont that said com
pany fails to carry out and perform tire terms and cond1ons
herein expressed or implied,to be y it carried out,the sown
shall in wriiing notify said company wherein it has so failed to
carry out or perfort any such terms or conditions,and in case
of ilure on the jiart of said company to comoly therewith with—

then it shall be optional with the Town of Estos Park by resolu
tion duly adopted to cancel and terminate this ordinance;and it
is further agreed that in the event conditions arise which make
this franchise inadequate or inappllcai)le,so that fair and
equitable relations cannot be maintainod under this contract,
then it shall be subject to revision by hothoarties hereto or
cncellat ion
Section 7.If any section,paragraph,clause,sen
tence,phrase or wart hereof of this ordinance is for any reason
held invalid,such invalidity shall not affect the validity of
tire renaming portions of this ordinance.The Board of Trustees
of the Town of Estos Park 1;erel)y declares that it wou have
passed this ordinacc,and each section,ragraph,clause,sen
tence or phrase thereof,irrespective of tire fact that any one
or more of the other sections,paragrawhs,clauses,sentences or
phrases or rarts hereof be declared invalid.
Section 8.Any and all ordinances and parts of ordin
ances in conflict herewith are hereby repealed.
Section 9 This oridnance is necessary for the imme
diate preservation of the public peace,health and safety and
in the,opinion of the Doard of Trustees an emergency exists;there
fore,this ordinance shall take effect innodiately after its final
passage and publication.
