AN ORDINANCE OF THE TOWN OF ESTES PARK,COLORADO,REGULATING THE ERECTION,CONSTRUCTION,ENLARGEMENT,ALTERATION,REPAIR,MOVING, REMOVAL,DEMOLITION,CONVERSION,OCCUPANCY,EQUIPMENT,USE,HEIGHT, AREA,AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE TOWN OF ESTES PARK,COLORADO;ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE,1958 EDITION,”EXCEPT AS HEREIN MODIFIED AND WITH THE EXCEPTION OF CHAPTER 51 IN ITS ENTIRETY;THE “BUILDING EXITS CODE,1959 EDITION”;AND CHAPTER 52 OF THE BUILDING CODE OF THE CITY AND COU1’1TY OF DENVER,COLORADO,AS HEREIN MODIFIED,AS THE BUILDING CODE OF THE TOWN OF ESTES PARK,COLORADO;PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR;PROVIDING PENALTIES FOR THE VIOLATION THEREOF;DECLARING AND ESTABLISHING FIRE ZONES;REPEALING ORDINANCE NO.170 OF THE TOWN OF ESTES PARK, COLORADO AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1.Building Code of Estes Park,Colorado:That there is hereby adopted as the Building Code of the Town of Estes Park,Colorado the following codes: 1.“Uniform Building Code,1958 Edition,Vol.1,published by the International Conference of Building Officials”except as herein modified,and wfth the exception of Chapter 51 in its entirety. 2.“Building Exits Code,Sixteenth Edition,1959,published by the National Fire Protection Association in its entirety. 3.Chapter 52 of the Building Code of the City and County of Denver,Colorado,Denver Ordinance No.431,adopted December 11, 1958,except as herein modified. Section 2.Modifications to the Uniform Building Code:That the following modifications of the Uniform Building Code,1958 Edition,Vol.1,published by the International Conference of Building Officials,are hereby adopted: 1.For the word “city”wherever used in the Uniform Building Code there is substituted the word “town.” n Section 3.Modifications to Chapter 52,Denver Building Code: That Chapter 52 of the Denver Building Code is hereby modified as follows: 1.Wherever in Chapter 52 of the Denver Building Code the word “Denver”or “City of Denver”is used there is substituted theref or the word “Estes Park”or “Town of Estes Park.” 2.For the phrase “Fire Prevention Bureau”wherever used in Chapter 52 of the Denver Building Code there is substituted the phrase “Building Department.” 3.Any reference made in Chapter 52 of the Denver Building Code to “Chapter 51”is deleted. 4.For the word “section 460l(d)”thereverused in Chapter 52 of the Denver Building Code there is substituted the phrase “section 6002,Vol.1,Uniform Building Code.” 5.For the phrase ‘tElectrical Code”wherever used in Chapter 52 of the Denver Building Code there is substituted the phrase “National Electric Code.’t 6.For the word “Chapter 37”wherever used in Chapter 52 of the Denver Building Code there is substituted the phrase “Chapter 37,Vol.1,Uniform Building Code,1958 Edition.” 7.For the word “Chapter 3”as used in section 5201(5)of Chapter 52 of the Denver Building Code there is substituted the phrase “Chapter 3,Vol.1,Uniform Building Code,1958 Edition.’ 8.For “Chapter 49”as used in section 5203(b)of Chapter 52 of the Denver Building Code there is substituted the phrase “Chapter 49,Vol.1,Uniform Building Code,1958 Edition.” 9.For the word “Denver”as used in section 5216 of Chapter 52 of the Denver Building Code there is substituted the words “mile high.” -2- 0 10.The second paragraph of section 5217(c)of Chapter 52 of the Denver Building Code is deleted. 11.For the phrase “in Chapter 4”as used in section 5221(c) of Chapter 52 of the Denver Building Code there is substituted the phrase “in Chapter 4,Vol.1,Uniform Building Code,1958 Edition.” 12.For the phrase “in sections 1806 and 3304”as used in section 5221(i)of Chapter 52 of the Denver Building Code there is substituted the phrase “in sections i8o6 and 3304,Vol.1, Uniform Building Code,1958 Edition.” 13.For the phrase “see Chapter 32ir as used in section 5222(a)l of Chapter 52 of the Denver Building Code there is substituted the phrase “see Chapter 32,Vol.1,Uniform Building Code,1958 Edition.” 14.For the phrase “Chapter 50 or 54”as used in section 5222(a)2 of Chapter 52 of the Denver Building Code there is substituted the phrase ‘tThe Colorado State Plumbing Code or The National Electric Code.” 15.From section 5224(d)of Chapter 52 of the Denver Building Code the phrase “furnaces installed shall meet the requirements of Chapter 51”is deleted. 16.For the word “Chapter 39”as used in section 5226(b), Table 7,of Chapter 52 of the Denver Building Code there is substituted the phrase “Chapter 39,Vol.1,Uniform Building Code, 1958 Edition.” Section 4.Violations and Penalties:That it shall be unlawful for any person,firm,or corporation to erect,construct, enlarge,alter,repair,move,improve,remove,convert or demolish, equip,use,occupy,or maintain any building or structure in the city,or cause the same to be done,contrary to or in violation of any of the provisions of this Code. -3- Q Any person,firm,or corporation violating any of the provi sions of this Code shall be deemed guilty of a misdemeanor,and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed,continued,or permitted,and upon conviction of any such violation such person shall be punishable by a fine of not more than $300,or by imprison ment for not more than 90 Section 5.Fire Zones Established:That the entire incorporated Town of Estes Park is established as a Fire District,and said Fire District shall be known and designated as Fire Zones 1,2 and 3, and each Fire Zone shall include such territory or portions of the Town of Estes Park as shall be described,outlined and designated on a certain map on file in the office of the Town Clerk of the Town of Estes Park being marked and designated as “Fire Zones of the Town of Estes Park.”Jhenever in any Ordinance of the Town of Estes Park,or in any Code adopted by reference by any Ordinance of the Town of Estes Park,attention is directed to a fire zone, it shall be construed to mean one of the fire zones described, outlined and designated on the above-mentioned map. Section 6.Repeal of Conflicting Ordinances:That Ordinance No.170 of the Town of Estes Park,Colorado,entitled “An Ordinance Regulating the Erection;Construction;Enlargement,Alteration, Repair,Moving,Removal,Demolition,Conversion,Occupancy, Equipment,Use,Height,Area,and Maintenance of all Buildings and Structures in the Town of Estes Park;Providing for the Issuance of Permits and Collection of Fees Therefor;Providing Penalties for the Violation Thereof;Declaring and Establishing Fire Zones;Repealing Ordinance No.15 of the Town of Estes Park - 0 and All Other Ordinances and Parts of the Ordinances in Conflict Therewith,’t and all other Ordinances or parts of Ordinances of the Town of Estes Park,Colorado in conflict herewith are hereby repealed. The Board of Trustees finds this Ordinance is necessary to protect the interests of the public and for the immediate preserva tion of the public peace,health,and safety,and it shall take effect immediately upon its final passage and publication.
