HomeMy WebLinkAboutORDINANCE 209‘11 ORDINANCE NO 209 AN ORDINANCE RULATING THE USE AND OCCUPANCY OF STRrS,ALLEYS AND PUBLIC GROUNDS,PA3SED AND ADOPTED ON THE 11th DAY OF JULY,1960. Section 1.Be it Ordained by the Board of Trustees of the Town of Estes Park,Colorado that it shall be unlawful for any person,persons or corporation to use or occupy any street,alley or public ground for the purpose of moving a building across or thereon,without first having obtained a permit therefor from the Town Building Inspector,Said permit shall be issued only upon a written application therefor by the person,persons or corporation so desiring to use or occupy the street for moving purposes,and upon a form to be prescribed by the Town.Any per mit which may be issued under the provisions of this ordinance shall provide persons to whom it is issued,expressly agree to save the Town of listes Park harmless on account of any damage or i4iry to the street,alley or public ground so used,and on account of any damage or injury that may be sustained by any person or persons by reason of the use and occupancy of the street by the person so obtaining a permit. Section 2.Before a permit shall be issued under this ordinance a fee of ç15,0O shall be paid to the Town Building Inspector together with the estimated costs which the Town of Estes Park will incur for the safety of persons and the preservation of property and for any services required by the Town in connection with said permit. In the event the building to be moved has a loaded height of less than twelve feet and a width not to exceed eight feet,a permit shall be required,however,the permit fee may be waived,upon decision of the Building Inspector. Section 3.A surety bond in an amount to be deterdned by the Town Building Inspector shall he required before any permit is issued hereunder when in the discre tion of the Building Inspector the building to be moved is of such size or condition that the movement thereof might result in damage to property of the Town of Estes Park or to the property of any other person. Secön 4 That the Board of Trustees herewith finds,determines,and desig nates that this Ordinance is necessary for the immediate preservation of the public peace,health,and safety and whereas in the opinion of the Board of Trustees an emergency exists and that this Ordinance shall effect and be in force immediately after its passage and adoption.
