AN ORDINANCE APPROVING THE ANEEXATION OF
CERTAIN TERRITORY TO THE TOWN OF ESTES PARK,
COLORADO,TO BE KNOWN AND DESIGNATED AS
“BIRCH ADDITION TO THE TOWN OF ESTES PARK,
COLORADO.”
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
Section 1.That a petition for annexation,together with
four copies of a plat of said territory,as required by law,was
filed with the Board of Trustees on the 12th day of Anril,1954,
by two landowners,being the sole and only owners of all of the
territory hereinafter described,and who also comprise all of
the landowners residing in said territory at the time of the filing
of the petition herein;that the Board of Trustees,at its
regular meeting on the /day of
___________,
1954,accepted
said petition and caused to be published a notice as required
by law;that more than thirty days have elapsed after the first
publication of said notice,and no counter—petition has been filed.
Section 2.That the annexation to the Town of Estes
Park of the following described territory,to be known and
designated as “Birch Addition to the Town of Estes Park,Colorado”,
is hereby approved and the same is hereby annexed to the Town
of Estes Park,Colorado,and which territory is described as
follows,to-wit:
A portion of the Northwest quarter (Nw*)of the North
east quarter (NE*)of Section Twenty-five (25),and of the
Southwest quarter (SW)of the Southeast quarter (SE*)of
Section Twenty-four (24),Township Five (5)North,Range
Seventy-three (73)West of the Sixth Principal Meridian,
more particularly described as follows:Commencing at the
Northeast corner of Block Twelve (12),Town of Estes Park,
Colorado;thence North 75.8 feet;thence North 35°45’West
102.8 feet;thence South 4O058 East 146.4 feet to a point
on a line 37 feet East of the East line of said Block

Twelve (12)and parallel thereto;thence South along this
line about 613 feet to the center of Black Canon Creek;
thence Westerly along the center line of said Creek about
37 feet to the Southeast corner of said Block Twelve (12);
thence North about 6243 feet to the place of beginning,and
containing 0.66 acres,more or less.
Also,beginning at the Northeast corner of Block
Twelve (12),Town of Estes Park,Colorado;thence North
75.8 feet;thence North 35°45’West 102.8 feet;thence
South 690251 West 453 feetto a point in the center of
MacGregor Lane;thence East 484.3 feet to the place of
beginnig,and containing 1.05 acres,more or less,and
being a portion of the Southwest quarter (SW*)of the
Southeast quarter (SE*)of Section Twenty-four (24),
Township Five (5)North,Range Seventy-three (73)West
of the Sixth Principal Meridian.
Section 3.That the Board of Trustees herewith finds,
determines and designates that this ordinance is necessary for
the immediate preservation of the public peace,health and safety,
and whereas,in the opinion of the Board of Trustees,an emergency
exists,this ordinance shall take effect and be in force
immediately after its passage and adoption.
