HomeMy WebLinkAboutORDINANCE 141-54-- ORDINANCE No. AN ORDINANCE REGULATING THE CONSTRUCtION.IN3TPIIATION. REPAIR AND MAINTENANCE OF OUTDOOR RADIO AND TELEVISION RECEIVING ANTENNAS. T3E IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TCYJN OF ESTES PARK,STATE OF COLORADO. Section 1.No outdoor radio and!or television antenna mast shall hereafter be constructed or erected,enlarged or altered,within the Town of Estes Park,which does not conform to the requirements of this ordinance. Section 2.A written application for a permit to construct,erect,enlarge or alter any outdoor radio and!or television antenna shall be made to the Office of the Town Clerk, and whenever it is deemed necessary the Office of the Clerk may require plans of suchproposedconstructionbesubmittedtothatoffice.All applications and required plans shall be kept on file in the Office of the Town Clerk,together with a record of all permits issued hereunder.All permits shall be in writing. Section 3.Construction requirements are as follows; A•LIGHTNING ARRESTER.A lightning arrester shall be installed in each conductor of a lead—in from an outdoor antenna except that if lead—in conductors are enclosed in a continuous metal shield, the arrester may be used to protect the shield,or may be omitted if the shield is permanently grounded to a ground which has a re sistance of 25 ohms or less.The arrester shall not be located near highly combustible material or in a hazardous location. 3.GROFNDING KETAL SUPPORTS ON ROCFS.Metal supporting poles or masts extending more than ten feet above the supporting building shail be permanently and adequately grounded except poles or masts which are themselves used as antennas. C.SUPPORTS.Outdoor antenna and counter—poise and lead—in con ductors shall be securely supported.They shall not be attached to poles or similar structures carrying electric light or power wires. Insulators supporting the antenna or counter—poise conductors shall have sufficient mechanical strength to safely support the conductors. D.LEAD—IN CONDUCTORS ATTACHED TO BUILDINGS.Lead—in conductors attached to buildings shall be so installed that they cannot swing closer than two feet to the conductors of circuits of 250 volts or less,or closer than ten feet to conductors of circuits of more than 250 volts.The clearance between lead—in conductors and any conductor forming part of a lightning rod system shall not be less than six feet. Lead—ins shall be supported at intervals not less than fifteen feet apart. t_ E.OUTDOOR ANTENNAS.Outdoor antennas must be of an approved type,and shall not exceed the maximum height of fifty feet above a roof support or seventy feet above ground support on commercial buildings.Antennas on residences shall not exceed thirty feet above the roof support.In areas where reception may be affected by the obstruction of tall buildings or other objects of a similar nature,antennas in excess of the above specified height may be installed only when approved by the Town Council.Every antenna, mast and guy wire must be adequately grounded for protection against a direct stroke of lightning with the ground wire as specified in the 1914.7 National Electrical Code as the same may be amended.Inno case shall an antenna of twenty feet in height or more be installed nearer to street or sidewalk than the 1eight of the antennas.Masts and guy wires must be anchor screws or lead expansion shields installed in accordance with the recommendations of the Electrical Department of the Town of Estee Park.No wires,cables or guy wires shall cross or extend over any part of a public street,way or sidewalk. Chimney mounts on single flue,chimneys with less than three square feet of cross sectional area must be made with metal straps com pletely around the chimney.4ntenna may be mounted with anchors on chimneys of a size greater than three square feet of cross sectional area,provided that said chimney is in good condition.Anchors are to be set in holes drilled in the brick or masonry,and shall not he set in the mortar joints between the brick. F.GUYS FOR ALL PIPE MASTS.All pipe masts requiring guys shall be guyed by not less than three and preferably four guys evenly spaced.Guy wires shall be of non—corrosive,stranded cable or wire, and q,f 300 pound test strength.All guys shall be made mechanically secure to the roof,parapet or other masonry,attached to mast with rings or clamps.Guys shall not be installed at an angle of less than 30 degrees to the vertical mast.shall not be tightened in such a manner as to cause the mast to buckle.The miscellaneous hardware,such as brackets,turnbuckles,thimbles,clips,etc.,must be hot—dipped galvanized,or similarly treated for weather protection. The turnbuckles must be protected against turning by threading the guywire through the turnbuckles. G.PIPE MASTS OVER EIGHT FEET IN HEIGHT.Pipe masts over eight feet in height exclusive of the beam elements shall be guyed as outlined in Paragraph F. H.PIPE MASTS OVER EIGHT FEET IN HEIGHT JT NOT GREATER THAN ThTENTY FEET Pipe masts over eight feet but not greater than twenty feet in height exclusive of beam elements shall be guyed to a minimum of not less than two positions,the lower position not less than five feet or over eight feet from the base,and within five feet of the top, and shall be guyed as outlined in Paragraph F. I.PIPE MASTS OVER ThENT!FEET.Pipe antenna masts of over twenty feet in height,exclusive of the antenna elements,shall be guyed not less than five feet or over eight feet from the base.Subsequent guys shall be installed at intervals of three feet to ten feet above the first set of guys,and the top set shall be within five feet of the top of the mast.Guys shall be installed as outlined n Para graph F. J.FABRICATHD MAST TOWERS.Fabricated mast towers shall be install ed in accordance With the manufacturer?s recommendations.If the tower is over twenty feet high,it shall be supported by at least two sets of guys installed in accordance with regulations as outlined in Paragraph F. K.POWER LINES.If possible,all masts and towers shall be so installed that the mast and antenna cannot fail on power lines carry ing 250 volts or more in event of failure of the masts or guys. 1There the installation could fall on a power line,the installation shail not be made until approval has been obtained from the Electrical Department of the Town of Estes Park. L.INSTAlLATIONS,fLU installations shall be made in a neat,safe and workmanlike manner. Section Li..INSPECTION.DUTIES RIGHTS AND POWERS.It shall be the duty of the Electrical Superintendent and his authorized assistants to inspect all television and radio receiving antennas to ascertain if the work has been done in a worlQnanlike manner and to investigate all complaints from the general public pertaining to said antenna installations and inter ference caused thereby. The Inspector and his assistants are hereby empowered to inspect or reinspect any wiring,equipment or apparatus,conducting or using electrical current for radio and television receiving service in the Town,and if conductors,equipment or apparatus are found to be unsafe to life or property,or not in conformity with the provisions of this ordinance,the Inspector shall notify the person owning or operating the hazardous wiring or equipment to correct the condition within a forty—eight hour period or within the time the inspector specifies.Failure to correct violations within the 5pecified time shall constitute a violation of this ordinance. Section 5.UNLKIFUL TO INTERFERE WITH INSPECTOR.It shall be unlawful for any person to hinder or interfere with the inspector or his authorized representatives in the discharge of their duties under the provisions of this ordinance. Section 6.FEES.Upon completion of the proposed construction,an authorized represent ative of the Electrical Department of the Town of Estes Park shail inspect and examine the work to ascertain whether said work wonforms to the provisions of this ordinance,and this inspection fee shall be the sum of One Dollar (1l.00 )to be filed with the application for the permit. Section 7.AUTHORIZING ADDITIONAL RULES.In order to take advantage of progress and any change in the industry,the Electrical Superintendant may consult with members of the industry and other qualified persons and may put into effect any reasonable rules and reg ulations not in conflict with the provisions of this ordinance. Section B.PENALTIES.Any person who shall violate any provision of this ordinance shall, upon conviction tliereàf,be punished by a fine of not exceeding One Hundred lars,(ioO.oo) or by imprisonment n the Town Jail for a term not exceeding ninety (90)days. Section 9.SEPARABILITY.If any section,sub—section,sentence,clause,phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of comp etent jurisdiction,such portion shall be deemed a separate,distinct and independent provision and such holding shall not effect the validity of the remaining portions thereof. Section 10.ADAPTION AND GENCY.That for the better protection of life and property and in the interest of the public safety this ordinance is deemed necessary for the preservation of the public peace,health and property;therefore,it shall take effect immediately upon its introduction and passage,approval and publication.
