HomeMy WebLinkAboutORDINANCE 170-57——I (I.II ierIc &RecQreJ THE TCN OF ESTES PARK COLORADO ORDINANCE NO./7 ô AN ORDINANCE REGULATING THE ERECT ION CONSTRUCT ION ENLARGEMENT,ALTERATION, REPAIR,MOVING,R4OVAL,DEMOLTT ION,CONVERSION,OCCUPANCY,EQUIPMENT,USE HEIG!T, AREA,AND MAINTENANCE OF ALL BUILDINGS AND STRUCTURES IN THE T(MN OF ESTFS aRK; PROVIDING FOR THE ISSUANCE OF PERMTT$AND COLLECTION OF FEES THEREFOR;PROVIDING PENALTIES FOR THE VIOLATION THEREOF;DECLARING AND ESTABLISHING FIRE ZONES;REPEALING ORDINANCE NO.15 OF THE T(MN OF ESTES PARK AND AlL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFlICT THEREMTTH. BE )]‘ORDAINRD BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARX COlORADO: Section 1.Pursuant to the authority conferred by Chapter 339,Article 34., Section 2,of Colorado Revised Statutes,1953,there is hereby adopted as the building Ordinance and code for the Town of Estee Park,“The Uniform Building Code,Volume 1 Edition,published 1955 by Inta national Conference of Building Officials”. Section 2.That a certain document,three (3)copies of which are on file in the office of the Town Clerk of the Town of Estes Park,being nrked,and designated as “Uniform Building Code,Volume 1 Edition,published 1955 by International Conference of Building Officials,”be and the same is hereby adopted as the building code of the Town of Estee Park for regulating the erection,construction,enlargement,atiteration,repair, moving,xemoval,demolition,conversion,occupancy,equipment,use,height,area,and maintenance of ail buildings,and/or structures in the Town of Estee Park;providing penalties for violation of such code;declaring and establishing fire zones;and each and ail of the regulations,provisions,penalties,conditions and t erms of such “Uniform Building Code,Volume 1 Edition,published 1955 by mt €rnational Conference of Building Officials,”on file in the office of the Town Clerk are hereby referred to,adopted,and made a part hereof as if fuily set out in this Ordinances Section 3.That Ordinance No.15 of the Town of Estes Park entitled an Ordinance in relation to building construction and building permits,in the fire 1i,olts of the Town of Estee Park,and ail other Ordinances or parts of Ordinances in conflict herewith are hereby repealed. ‘.7 . 4 . Section 4.That the entire incorporated area of the Town of Estee Park is hereby declared to 5 e and is hereby established as a Fire District and said Fire District shall be known and designated as Fire Zones 1,2,and 3,and each such zone shall include such territory or portions of said Town as illustrated,outlined,and designated on a certain nap on file in the office of the Town Clerk of the Town of Fetes Park being marked,and designated as “Fire Zones of the Town of Fetes Park”,which is hereby adopted as the fire zoning nap of the Town of Estee Park for the application of the regulations included in the “Uniform Building Code,Volume 1 Edition,published 1955 by Intnational Conference of Building Officials0” Section 5.That the Town Clerk shall certify to the adoption of this Ordinance and cause the same to be published. Section 6.That the following amendments to the “Uniform Building Code,Volume 1 Edition,published 1955 by Tht national Conference of Building Officials,”include where the ‘term !!Oity”is referred to in said Code,be changed to read “Town”. Section 7.Section 104 Ii.Concerning Moved Buildings of said building code is hereby amended and supplemented by including therein the following:To prohibit House Trailers. The term “House Trailer”as used herein shall be construed to mean any structure built on a wheel or wheels or designed to be used by a person or persons for living or sleeping purposes;such term shall include any motor or horse drawn vehicle which is used or designed to be used by a person or persons for living or sleeping purposes and said house trailer will not be considered a conforming building or structure under Volume 1 Edition published 1955 of the “Uniform Building Code by International Conference of Building Officials,”unless located in a licensed trailer camp as set forth in Ordinance No.84 of the Town of Estee Park,dated May 8,1939, Section 8.Section 203 a.Concerning Unsafe Buildings of said building code is hereby amended and supplemented by including therein the following:“Non-conforming buildings shall be deemed unsafe and total replacement required when forty (40)per cent of the replacement valuation of similar type construction has been damaged by fire or other means,Conforming buildings shall be deemed unsafe and total replacement required when 75 (seventy—five)per cent of the replacement valuation of similar type construction has been damaged by fire or other means. Section 9.Section 1405 a.Concerning Windows in requirements for Group I Occupancy of said building Code is hereby amended by deleting the last sentence of the first paragraph reading “Not less than one—half such area shall be openable.” Section 10.Section 1602.Concerning Street Exposures in Fire Zone 1 of said building code is hereby amended and supplemented by including therein the following:“AU occupancies in buildings or parts of buildings or structures in Class I Fire Zone shall require a minimum street exposure of ten (10)feet and 300 square feet in area and provide . sanitation facilities within s aid building or parts of said building or structure.AU buildings or structures in Class I Fire Zone,except private garages and private warehouses, must front directly on a street or front on a privately owned parking lot,as in the case of a shopping center parking lot,with said parking lot providing service entrances on at least two sides to city streets.Said service entrances shall be connected with a minimum of a twenty (20)foot un—obstructed passageay, Section U.Section 205.Violations and Penalties as setforth in “Uniform Building Code,Volume 1 Edition,published 1955 by International Conference of Building Officials”. It shall be unlawful for any person,firm,or corporation to erect,construct,enlarge, alter,repair,move,improve,remove,convert or demolish,equip,use,occupy,or maintai any building or structure in the city,or cause the same to be done,contrary to or in violation of any of the provisions of this Code. Any person,firm,or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor,and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed,continued,or permitted,and upon conviction of any such violation such person shall be punishable by a fine of not more than 30O,or by imprisonment for not more than 90 days,or by both such fine and imprisonment. Section 12.This Ordinance is hereby declared and found to be necessary for the immediate preservation of the public peace,health and safety,and shall take effect immediately after its final passage arid piblication. Section 13.The reasons why this Ordinance is thus necessary is that it is intended to safeguard persons and property,and is a fire prevention measure, INTRODUCED,REM),PASSED,ADOPrED,AND ORDEFFD PUBLISHED this )i of _________ 1957.
