A1’T ORDINANCE CONCERNING WASTE MATERIALS
AND TRE DISCARD AND ABANDOM4ENT THEREOF
AND PROVIDING FOR REMOVAL TIREOF AND
PENALTIES FOR TRE VIOLATION
BE IT ORDAINED BY T BOARD OF TRUSTEES OF TRE TOWN
OF ESTES PARK,COLORADO:
Section 1.It shall be unlawful for any person,
firm or corporation to cause or permit junk,scrap metal,scrap
lumber,waste paper products,discarded building materials,
furniture or furnishings,or any unused,abandoned vehicle,
vehicles or abandoned parts,machinery or machinery parts,or
other waste material,to be left or accumulated in or upon any
yard,garden,lawn,outbuilding or premises in the Town of
Estes Park,unless in connection with a business enterprise
lawfully situated and licensed for the same.It shall be
unlawful to permit any accumulation of any such waste material
in or upon any yard,lawn,garden,outbuilding or premises in
the Town of Estes Park if the same constitutes a fire hazard
or hazard to the safety of persons or property or an unsanitary
condition.
The Chief of Police or the Town Health and Sanitation
Inspector are hereby authorized and empowered to examine or
cause to be examined every premises suspected t0 contain an
unlawful accumulation of such waste material,and if the same
be found,to give to the person responsible for the same,or
the owner or occupant of the premises upon which found,a written
notice stating that an unlawful accumulation of waste material
has been found upon the premises,and directing the person to
whom the notice is addressed to eliminate the violation within

a reasonable time specified in such notice.The time so provided
shall be commensurate with the work required to be done to
correct the unlawful condition.Proper service of any such
notice shall be personal service upon the person responsible
for the unlawful accumulation,or the owner,authorized property
management agent,or the occupant of the premises.Alternatively
such service may be made to such person by registered or certified
mail and return receipt requested.
Failure of any person to carry out the work required
to be done by any such notice within the time specified by
such notice shall constitute a misdemeanor,and any person,
firm or corporation who shall violate the provisions of this
ordinance shall upon the conviction thereof be fined in a sum
not exceeding $300.00.
Section 2,It shall be unlawful for any person to
discard or abandon any of the waste material mentioned in Section
1 hereof upon premises not owned or occupied by such person
without the consent of the owner thereof or the person occupying
the same,and such waste material So deposited Without such
consent shall be deemed to have been discarded and abandoned if
the same remain upon such premises for a period exceeding 72
hours.Discarding and abandonment of any such waste material
shall be deemed to be permission by the owner thereof to the
Town of Estes Park to remove and dispose of the same as pro
vided by law for discarded,abandoned and unclaimed property,
and the Town of Estes Park and its officers and agents may
summarily remove the same and dispose of the same as provided
by law.

Section 3.This ordinance is hereby declared and
found to be necessary for the immediate preservation of the
public peace,health and safety,and shall take effect
immediately after its final passage and publication.
