HomeMy WebLinkAboutORDINANCE 279-654Th ORDINANCE NO.279 AN ORDINANCE AMENDING CHAPTER 17 OF THE MtJNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,BY ADDING SECTION 17.30,THE SAME PERTAINING TO OPEN DISPLAY OF FERMENThD MALT BEVERAGES AND ANY MALT,VINOUS OR SPIRITUOUS LIQUORS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Chapter 17 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended by adding thereto the following: 17.30 Open Display of Fermented Malt Beverages and any Malt,Vinous or Spirituous Liquors.It shall be unlawful to drink or openly display any fermented malt beverages and any malt,vinous or spirituous liquors in or upon any street,alley or other public way within the Town. And it shall be unlawful to sell,serve,drink or openly display any fermented malt beverages and any malt,vinous or spirituous liquors in or upon any public building,public park or any other public place within the Town or upon the premises of any restaurant,lunch stand,store or other place of business within the Town,except at such places where the same may lawfully be sold or sold and served as provided by the laws of the State of Colorado. Section 2.It is the intention of the Board of Trustees that the provisions of this ordinance are hereby declared to be severable,and if any section provision or part thereof shall be held to be unconstitutional or invalid, the remainder of this ordinance shall continue in lull force and effect,it being to the legislative intent that this ordinance would have been adopted even if such unconstitutional matter had not been included therein.It is further declared \ .—‘0 b 0 that if any provision or part of this ordinance,or the application thereof to any person or circumstance,is held invalid,the remainder of this ordinance and the application thereof to other persons shall not be affected thereby. Section 3.The Board of Trustees herewith finds, determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,and whereas in the opinion of the Board an emergency exists,this ordinance shall take effect and be in force five ()days after its final passage,adoption and publication. — Mayor -, -2-
