HomeMy WebLinkAboutORDINANCE 281-650 ORDINANCE NO.28/ AN ORDINANCE VACATING A PORTION OF A STREET DEDICATED TO PUBLIC USE IN THE I&EST 100 FEET OF LOT 28,TOWN OF ESTES PARK,COLORADO. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That that portion of Cleave Avenue and Prospect Drive,also known as Cleave Street and Spruce Drive, located within the West 100 feet of Lot 28,Town of Estes Park,Colorado,more particularly described as follows: Commencing at the Corner of Blocks 8,9,2L1 and 25 of the original p1st filing of the Town of Estes Park;thence S.03°-17’E.a distance of L21.l feet to the center line location and the P.C.(Station 0 +00)of a curve locating Prospect Drive as shown on the city map titled “Relocation of Prospect Drive”,surveyed by Fulton and Griffith on February,19L17 and recorded in Book 833,Page 358,of the County Court Records; thence N.87°-15’E.a distance of 20 feet to the brass cap Right-of-Way marker and P.C.of the East Right-of-Way of Prospect Drive and the true point of beginning of the above mentioned lot,thence 5.1°-02’W.a distance of 143.65 feet;thence 38.0 feet along an arc curve of a 50 foot radius with a cord length of 37.1 feet and a bearing of S.LI°-35’E.and maximum ordinate of 3.5’; thence N.89°-L8’E.along the North Right-of- Way of Elkhorn Avenue,a distance of 73.5 feet; thence N.0°—12’W.a distance of 106.0 feet to the North edge of Fall River;thence N.85°-L8’ W.a distance of 97.9 feet to a point on the East Right-of-Way line of Prospect Drive;thence S. 1°-021 W.a distance of L3.5 feet to the true point of beginning; be and the same is hereby vacated. Section 2.The Board of Trustees of the Town of Estes Park herewith finds,determines and declares that said portion of said streets is not needed for ingress or egress to or from any property adjacent thereto,and that the convenience of the people will not in any way be affected or impaired by vacating said portion of said streets,and that the owner of the land abutting on said portion of said streets has duly requested the Board of Trustees to vacate the same. •© Section 3.The Board of Trustees of the Town of Estes Park herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
