HomeMy WebLinkAboutORDINANCE 301-66Q r - ORDINANCE NO.301 AN ORDINANCE FOR THE REGULATION OF TRAFFIC UPON 1E STREETS OF TEE TOWN OF ESThS PARK, COLORADO.ADOPTING BY REFERENCE THE “MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES, 1966”.AMENDING SECTION 19.1 OF THE MUNICIPAL CODE OF THE TOWN OF ESES PARK,COLORADO,AND ALL OTHER ORDINANCES IN CONFLICT WITH ThIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF TRUSThES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Pursuant to Chapter 139,Article 3L1, C.R.S.1963 there is hereby adopted for the purpose of regulating traffic within the Town of Estes Park,Colorado, that certain ordinance known as the “Model Traffic Code for Colorado Municipalities,1966”officially approved,adopted, and published as such by the Colorado Highway Safety Council and hereinafter referred to as the “Municipal Traffic Code” of which three (3)copies are now filed in the office of the Town and may be inspected during regular business hours,the same being adopted as if set out at length save and except the following articles and sections which are declared to be inapplicable to this municipality and are thereby expressly deleted:Sections 26-1,26-2,and 27-1 through 27-6. Section 2.Application of ordinance. (a)This ordinance shall apply to every street,alley,sidewalk or sidewalk area,driveway,park,and to every other public way or public parking area,either within or outside the corporate limits of this municipality, the use of which this municipality has jurisdiction and authority to regulate. (b)The provisions of sections $-l, -2,-ll,and 23-3 of said Model Traffic Code respectively concerning careless driving,reckless driving,unauthorized devices,and accident investigation shall apply not only on streets and highways but elsewhere within this municipality. C 0 Section 3.Penalties for violations.The following penalties,herewith set forth in full,shall apply to the provisions of the Municipal Traffic Code herein adopted: (a)It is unlawful for any person to violate any of the provisions of the Municipal Traffic Code and any such violation shall be punishable as is hereinafter provided. (b)Every person convicted of a violation of any provision of this ordinance shall be punished by a fine of not less than $1.00 nor more than $300.00 or imprisoned for a term of not less than one day nor more than ninety days for each offense.Where any violation is a continuing offense, each day that the violation continues shall be considered and held to be a separate and distinct offense. Section L..Effect of ordinance.If any part or parts of this ordinance are for any reason held to be invalid or unconstitutional,such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts thereof,irrespective of the fact that any one part or parts be declared invalid or unconstitutional. Section 5.Repeal.All ordinances or parts of ordinances in conflict with or inconsistent with the pro visions of this ordinance are hereby repealed,except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 6.Certification of ordinance.The town clerk shall certify to the passage of this ordinance as published and cause the same to be certified for adoption. Section 7.Short title.This ordinance may be known and cited as the Municipal Traffic Ordinance. C Section 8.That Section 19.1 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended to read: 19.1 Model Traffic Code Adopted.There is hereby adopted and incorporated herein by reference that certain document known as the “Model Traffic Code for Colorado Municipalities, 1966”,officially approved and adopted on February 17,1966 by the Colorado Highway Safety Council,a division of the Executive Department of the State Government,under the authority vested by the State General Assembly. Section 9.The Board of Trustees herewith finds, determines and designates that this ordinance is necessary for the immediate preservation of the public health and safety for regulation of traffic affects the public health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage, adoption and publication. The above ordinance was passed on second reading and adopted by the Board of Trustees of the Town of Estes Park, Colorado at its regular meeting held on Monday,September 12, 1966.
