AN ORDINANCE ANDNDING SECTIONS 16.1 AND 16.3 OF THE
MUNICIPAL CODE OF THE TOWN Of ESTES PARK,COLORADO,
THE SANE PERTAINING TO THE DERINIT ION OF GARBAGE AND
WASTE AND THE BURNING OF GARBAGE,WASTE OR OTHER
MATERIALS OR MATTER.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
Section 1.That Section 16.1 of the Municipal Code of the
Town of Estes Park,Colorado be and the same is hereby amended to
read as follows:
16.1 Definition of Garbage and Waste.As used herein,the
word T1garbage?shall include kitchen and table refuse,offal,any
decaying vegetable matter,and all substances which attend the
cooking,dealing in,processing or storage of meats,fowl,fruits
or vegetables.As used herein,the word waste!1 shall include all
refuse from places of human or animal habitation,industry or
business.
Section 2.That Section 16.3 of the Municipal Code of the
Town of Estes Park,Colorado be and the same is hereby amended to
read as follows:
16.3 Burning of Garbage,Waste,Materials or Matter,Unlawful.
It shall be unlawful for any person to burn or cause to be burned any
garbage within the corporate limits.It shall be unlawful for any
person to burn or cause to be burned,within the corporate limits,any
waste or other materials or matter outside of a building except within
an incinerator approved by the Town Building Inspector;provided,that
no waste or other materials or matter shall be burned outside of a
building within Fire Zone 1 of the Town.
Section 3.The Board of Trustees of the Town of Estes Park
herewith finds,determines and designates that this ordinance is
necessary for the immediate preservation of the public peace,health

and safety,for the burning of garbage,waste or other materials or
matter affects the public health and safety,and thereas in the opinion
of the Board of Trustees an emergency exists,this ordinance shall take
effect and be in force five (5)days after its final passage,adoption
and publication.
