AN ORDINANCE REPEALING AND RE-ENACTING
CHAPTER 8 OF THE MIJICIPAL CODE OF THE
TOWN OF ESTES PARK,COLORADO,RELATING
TO HEALTH AND SANITATION.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.That Chapter 8 of the Municipal Code of
the Town of Estes Park,Colorado be and the same is hereby
repealed and re-enacted to read:
Chapter 8
HEALTH AND SANITATION
8.1 Individual and Institutional Waste Disposal
Systems -Unlawful Without Permit.It shall be unlawful for
any person,persons or corporation to construct or reconstruct
in the Tow-n of Estes Park,any individual or institutional
waste disposal system without first obtaining a sewage disposal
system permit from a duly authorized officer of any county,
district or state health department having jurisdiction and
authority to issue such permit.
8.2 Ground Conditions Unlawful.It shall be unlawful
for the owner of any real property to permit the presence of
human excrete or septic tank effluent on the ground surface
of his property.
8.3 Cesspools and Earth Privies Unlawful.It shall
be unlawful to install,construct or maintain a cesspool or
earth privies in the Town of Rates Park.
8.L Dead Animals.It shall be unlawful for any
person to bring into or allow to remain in the Town of Estes
Park,any dead animal or decaying animal matter;and any
animal dying within the Town shall be removed by the owner
or keeper thereof within 2L hours after its death.
8.Town Dump.It shall be unlawful for any person
to deliver more than one load of refuse per day to the Town
Dump without obtaining prior approval from the Dump Manager.

Section 2.The repeal of Chapter 8 of the Municipal
Code of the Town of Estes Park,by this ordinance shall not
affect any right which has accrued,or duty imposed,any
penalty incurred,or any action or proceeding commenced under
or by virtue of the chapter repealed.
Section 3.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates that
this ordinance is necessary for the immediate preservation of
the public peace,health and safety,for the regulation of
health and safety affects the public peace,health and safety,
and whereas in the opinion of the Board of Trustees an
emergency exists,this ordinance shall take effect and be in
force five ()days after its final passage,adoption and
publication.
