HomeMy WebLinkAboutORDINANCE 01-72ORDINANCE NO.1-72 AN ORDINANCE FOR THE REGULATION OF ELECTRIC CONDUCTORS AND EQUIPMENT INSTALLED WITHIN OR ON PUBLIC AND PRIVATE BUILDINGS AND OTHER PREMISES,INCLUDING YARDS,CARNIVAL AND PARKING LOTS,AND INDUSTRIAL SUBSTATIONS, ALSO THE CONDUCTORS THAT CONNECT THE INSTAL LATIONS TO A SUPPLY OF ELECTRICITY,AND OTHER OUTSIDE CONDUCTORS ADJACENT TO THE PREMISES, ALSO MOBILE HOMES AND RECREATIONAL VEHICLES WITHIN THE TOWN OF ESTES PARK,COLORADO;FOR THE PURPOSE OF SAFEGUARDING OF PERSONS AND OF BUILDINGS AND THEIR CONTENTS FROM HAZARDS ARISING FROM THE USE OF ELECTRICITY FOR LIGHT, HEAT,POWER,RADIO,SIGNALLING AND OTHER PURPOSES;ADOPTING BY REFERENCE THE NATIONAL ELECTRIC CODE,1971 EDITION;AMENDING SECTION 11.5 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO;REPEALING ALL ORDINANCES IN CONFLICT THEREWITH;AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Adoption.Pursuant to Chapter 159, Article SLi-,Colorado Revised Statutes 1965,as amended,there is hereby adopted by reference all of the “National Electric Code,”1971 Edition,(NFPA No.70—1971;ANSI C1—1971)adopted by the National Fire Protection Association of 60 Batterymarch Street,Boston,Massachusetts 02110,at its annual meeting held May 17-21,1971,in San Francisco,California and approved by the American National Standards Institute on June 25,1971,and hereinafter referred to as the “National Electric Code”of which three (5)copies are now filed in the office of the Clerk of the Town of Estes Park,Colorado,and may be inspected during regular business hours,the same being adopted as if set out at length. Section 2.Additions or Modifications:None. Section 5.Penalties.The following penalties,here with set forth in full,shall apply to this ordinance: (a)It is unlawful for any person to violate any of the provisions stated or adopted in this ordinance. (b)Every person convicted of a violation of any provision stated or adopted in this ordinance shall be punished 0 0 by a fine not exceeding three hundred dollars ($300.00),or by imprisonment not exceeding ninety (90)days,or by both such fine and imprisonment. Section 4.Application.This ordinance shall apply to all electric conductors and equipment installed within or on public and private buildings and other premises,including yards,carnival and parking lots,and industrial substations, also the conductors that connect the installations to a supply of electricity,and other outside conductors adjacent to the premises,also mobile homes and recreational vehicles within the corporate limits of this municipality. Section 5.Validity.If any part or parts of this ordinance are for any reason held to be invalid,such decision shall not affect the validity of the remaining portions of this ordinance.The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts thereof,irrespective of the fact that any one part or parts be declared invalid. Section 6.Repeal.Existing ordinances or parts of ordinances covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed,except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 7.Interpretation.This ordinance shall be so interpreted and construed as to effectuate its general purpose of safeguarding of persons and of buildings and their contents from hazards arising from the use of electricity for light,heat,power,radio,signalling and other purposes. Article and section headings of the ordinance and the adopted National Electric Code shall not be deemed to govern,limit, —2— modify or in any manner affect the scope,meaning or extent of the provisions of any article or section thereof. Section 8.That Section 11.5 of the Municipal Code of the Town.of Estes Park,Colorado be and the same is hereby amended to read: 11.5 National Electric Code Adopted.All electrical conductors and equipment installed within or on public and private buildings and other premises,including yards, carnival and parking lots,and industrial substations,also the conductors that connect the installations to a supply of electricity,and other outside conductors adjacent to the premises,also mobile homes and recreational vehicles,located within the corporate limits of this municipality,shall be installed in conformity with the requirements of the National Electric Code,1971 Edition,(NFPA No.70—1971;ANSI C1—1971) adopted by the National Fire Protection Association of 60 Batterymarch Street,Boston,Massachusetts 02110,at its annual meeting held May 17-21,1971,in San Francisco, California and approved by the American National Standards Institute on June 25,1971,which National Electric Code,is incorporated herein and adopted by reference. Section 9.Publication.The Town Clerk shall certify to the passage of this ordinance,cause notice of its contents and passage to be published,and make not less than three (3) copies of the adopted Code available for inspection by the public during regular business hours. Section 10.Effective Date.The Board of Trustees herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety for the regulation of the installation of electrical conductors and equipment has a bearing upon the public health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication. —— .,fl PASSED BY THE BOARD OF TRUSTEES AFTER PuBLIC HEARING AND SIGNED THIS /ft//DAY OF FEBRUARY,1972.
