ORDINANCE NO.41-72
AN ORDINANCE AMENDING SECTION 6.6 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO TAPPING CHARGE -
WATER RIGHTS FEE,AND CONNECTION DATES.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.That the second paragraph of Section 6.6
of the Municipal Code of the Town of Estes Park,Colorado,is
amended to read as follows:
In addition to the foregoing water tap fee,the
consumer shall pay to the Town a water rights fee in accordance
with the following schedule:
Single family dwelling $194.50
All other water users,except those
special users provided for below,
not less than $194.50,and an
additional $9.72 for each roughed in
or installed fixture unit in excess
of 20 fixture units;
except those consumers applying for a tap to be used on
property for which there has been furnished water,or its
money equivalent paid,when the property was annexed to the
Town.
Section 2.That the seventh paragraph of Section 6.6
of the Municipal Code of the Town of Estes Park,Colorado,is
amended to read as follows:
All property for which a connection fee has been
paid after December 1,1972,as herein provided,must be connected
to the Town’s water system and put into service for the improve
ment it is to serve within one (1)year from the date of the
payment of such fee.All property for which a water connection
fee has been paid after January 20,1966,but before December 1,
1972,must be connected to the Town’s water system and put into
service for the improvement it is to serve within ten (10)years
from the date of the payment of such fee.All property for which
a connection fee has been paid prior to January 20,1966,must
0 0
be connected to the Town’s water system and put into service
for the improvement it is to serve prior to January 20,1986.
After the expiration of the applicable heretofore provided
connection dates,a new application for water service must be
made and another connection fee paid,at the rate then
prevailing for such lees,before water service will be furnished
to the property for which the application pertains.
Section 5.The Board of Trustees of the Town of Estee
Park,Colorado,herewith finds,determines and designates that
this ordinance is necessary for the immediate preservation of
the public peace,health and safety for tapping charges and
water rights fees affects the public peace,health and safety,
and whereas in the opinion of the Board of Trustees an
emergency exists,this ordinance shall take effect and be in
force five (5)days after its final passage,adoption and
publication.
PASSED BY THE BOARD OF TRUSTEES AND SIGNED THIS 27th
DAY OF November ,1972.
