HomeMy WebLinkAboutORDINANCE 33-72I 0 ORDINANCE NO.33 -72 AN ORDINANCE FOR TEE REGULATION OF BUILDINGS AND STRUCTURES IN THE TOWN OF ESTES PARK, COLORADO:ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE,VOLUME IV,1970 EDITION,KNOWN AS THE UNIFORM CODE FOR REPAIR,VACATION OR DEMOLITION OF DANGEROUS BUILDINGS;AMENDING SECTION 11.1 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO;AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAIHED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Adoption.---Pursuant to Chapter 139, Article 3l,Colorado Revised Statutes 1963,as amended,that the Uniform Building Code,Volume IV,1970 Edition,known as the “Uniform Code for Repair,Vacation or Demolition of Dangerous Buildings,1’issued by the International Conference of Building Officials,36O South Workman Mill Road,Whittier, California 90601,at least three (3)copies of which have been certified as true copies by the Mayor and the Clerk of the Town of Estes Park,Colorado,and which are now on file in the office of the Town Clerk,is hereby adopted by reference. Section 2.Additions or Modifications:Section 201 (c)3 is hereby deleted from the Uniform Building Code, Volume IV,1970 Edition,and has no application to any provisions of said Code. Section 3.Penalties.The following penalties,here with set forth in full,shall apply to this Ordinance: (a)It is unlawful for any person to violate any of the provisions stated or adopted in this Ordinance. (b)Every person convicted of a violation of any provision stated or adopted in this Ordinance shall be punished by a fine not exceeding Three Hundred Dollars ($300.00), or by imprisonment not exceeding ninety (90)days or by both such fine and imprisonment. (c)Where any violation is a continuing offense,each day that the violation continues shall be considered and held to be a separate and distinct offense. G Section L1...Application.This Ordinance shall apply to all dangerous buildings and structures,as defined in the Uniform Building Code,Volume IV,1970 Edition,either exist ing or hereafter erected in the Town of Estes Park,Colorado. Section 5.Validity.If any part or parts of this Ordinance are for any reason held to be invalid,such decision shall not affect the validity of the remaining portions of this Ordinance.The Board of Trustees hereby declares that it would have passed this Ordinance and each part or parts thereof,irrespective of the fact that any one part or parts be declared invalid. Section 6.Interpretation.This Ordinance shall be so interpreted and construed as to effectuate its general purpose of providing a just,equitable and practicable method whereby buildings or structures,either existing or hereafter erected,which from any cause endanger the life,limb,health, morals,property,safety or welfare of the general public or their occupants,may be required to be repaired,vacated or demolished.Article and section headings of the Ordinance and the adopted Uniform Building Code,Volume IV,1970 Edition, shall not be deemed to govern,limit,modify or in any manner affect the scope,meaning or extent of the provisions of any article or section thereof. Section 7.That Section 11.1 of the Municipal Code of the Town of Estes Park,Colorado,be and the same is hereby amended by adding thereto the following: Any dangerous building or structure,either existing or hereafter erected,as defined in the Uniform Building Code, Volume IV,1970 Edition,known as the TtUniform Code for Repair, Vacation or Demolition of Dangerous Buildings,11 issued by the International Conference of Building Officials,5360 South Workman Mill Road,Whittier,California 90601,shall be repaired,vacated or demolished in conformity with the require ments of said Code which said Code is incorporated herein and adopted by reference. -2- Section 8.Publication.The Town Clerk shall certify to the passage of this Ordinance,cause notice of its contents and passage to be published,and make not less than three (3) copies of adopted Code available for inspection by the public during regular business hours. Section 9.Effective Date.The Board of Trustees herewith finds,determines and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety for the regulation of dangerous buildings has a bearing upon the public peace,health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this Ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
