AN ORDINANCE AMENDING SECTIONS 13.32.100 and 13.32.120
OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,
RELATING TO WATER RATES AND CHARGES FOR THE SUPPLYING OF
WATER BY THE WATER DEPARTMENT OF THE TOWN OF ESTES PARK,
COLORADO,TO CERTAIN RESIDENTIAL CONSUMERS,AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
Section 1.Sections 13.32.100 and 13.32.120 of the Municipal
Code of the Town of Estes Park,Colorado,are amended to read as follows:
13.32.100 Residential gravity flow water rate schedule R-1 (urban).
Applicability.This schedule is applicable for water service to residential
consumers within the town limits.
Availability.This schedule is available only for domestic use
in single—family private dwellings,multi-family dwellings or apartments to
which water can be furnished by the town’s Qravity flow water system.It is
not available for swimming pools,where water is used on a continuous basis,
or where water must be furnished to the property by a town owned and town
maintained pumped flow water system.
Rate.
For each family dwelling unit $63.00
Where a hose bibb is installed,an additional
minimum charge will be made of 7.90
which includes the irrigation of the first one
thousand square feet or less of irrigated
lot area.
For each one hundred square feet or irrigated lot
area in excess of one thousand square feet,an
additional 39
Charges and Payment.The foregoing schedule is computed on an
annual basis.Payment shall be made in advance on July 1st of each year.
Bills for water service are due and payable within twenty days from date of
bill,and shall become delinquent within thirty days from date of bill.
Contract Period and Conditions.Service under this schedule shall
be for a minimum period of twelve months and thereafter until terminated.Ser
vice may be terminated on ten days’written notice.
Service under the foregoing schedule is subject to this code,town
ordinances and rules and regulations of the water department.
Annual Minimum Rates.An annual minimum rate of $31.50 for resi
dential property shall be charged for all property within the town limits
which is connected to the town’s water system,to which no water has been
supplied.No annual minimum charge shall be made for property disconnected
from the town’s water system.When property is disconnected from the town’s
water system,the tapping charge and water rights fee provided for in Section
13.32.010 shall be paid to the town clerk as a reconnection fee before water
service shall be restored to the property.
13.32.120 Residential gravity flow water rate schedule R-2 (rural).
Applicability.This schedule is applicable for water service to residential
consumers outside the town limits.
Availability.This schedule is available only for domestic use
in single-family private dwellinas,multi-family dwellings or apartments to
which water can be furnished by the town’s gravity flow water system.It is
not available for swimming pools,where water is used on a continuous basis,
or where water must be furnished to the property by a town owned and town
maintained pumped flow water system.
Rate.
For each family dwelling unit $110.00
Where a hose bibb is installed,an additional
minimum charge will be made of 13.80
which includes the irrigation of the first
one thousand square feet or less of irrigated
lot area.
For each one hundred square feet of irrigated lot
area in excess of one thousand square feet,an
additional .69

13.32.010 shall be paid to the town clerk as a reconnection fee before water

Section 2.The Board of Trustees of the Town of Estes Park,Colorado,
herewith finds,determines and designates that this ordinance is necessary
for the immediate preservation of the public peace,health and safety,for elec
tric rates affect the public peace,health and safety;and whereas in the
opinion of the Board of Trustees,an emergency exists,this ordinance shall
take effect and be in force as of the date of the first water billing period
commencing after July 1 ,1976,and after its final passage,adoption
and publication.
