AN ORDINANCE AMENDING SECTION 17.66.040 OF TIlE MUNICI
PAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING
TO THE EXEMPTION OF CERTAIN SUBDIVISION SIGNS FROM THE
SIGN CODE (CHAPTER 17.66 OF THE MUNICIPAL CODE).
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO:
Section 1.Section 17.66.040 of the Municipal Code of the Town of
Estes Park,Colorado is amended by the addition of paragraph 8,as follows:
8.Signs which identify lands which have heretofore been or which may
be hereafter subdivided in accordance with Title 16 of the Municipal Code of
the Town of Estes Park,Colorado,subject to the following regulations:
a.Such signs shall be allowed in the town
street right-of-way provided;
i.that the sign be located a minimum of ten
feet from the traveled portion of said right-
of-way,with the “traveled portion”to be as
determined by the Board of Trustees of the
Town of Estes Park,Colorado;
ii.if any such signs are in the form of a gate
way,a minimum of sixteen feet vertical clearance
from the toad surface shall be provided;
iii.such signs shall have the sign require
ments relating to site distances at intersections
as do other signs under the provisions of this
cli apt e r.
b.The maximum size for a subdivision identification
sign shall be thirty-six square feet.
c.The applicant for the sign permit shall be respon
sible to the town at all times subsequent to the date
of the erection of said sign for the maintenance thereof.
Should said permitee fail to so maintain the sign,then
and in that event the town shall remove the same at the
expense of the permitee after giving notice to the per
mitee pursuant to Section 17.66.050 of this chanter.
Section 2.The Board of Trustees of the Town of Estes Park,Colorado,
herewith finds,determines and designates that this ordinance is necessary
for immediate preservation of the public peace,health and safety for the re
gulation of zoning and signs affects the public peace,health and safety;and
whereas,in the opinion of The Board of Trustees an emergency exists,this or
dinance shall take effect and be in full force after its final passage,adop
tion and approval and signature of the mayor.
