AN ORDINANCE APPROVING THE ANNEXATION OF
CERTAIN TERRITORY TO THE TOWN OF ESTES PARK,
COLORADO,TO BE KNOWN AND DESIGNATED AS
“BINNS ADDITION”TO THE TOWN OF ESTES PARK,
COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
Section 1.That a petition for annexation,together with
copies of a plat of said territory as required by law,was filed with the
Board of Trustees on May 28,1976,by the owners of one hundred percent
(100%)of the area of the territory hereinafter described,exclusive of
streets and alleys.The Board of Trustees,by Resolution at its regular
meeting on July 13,1976,found and determined that said petition was in
substantial compliance with the requirements of Subsection (1)of Section
31-8—107 of CRS 1973,as amended;that the applicable parts of Sections
104 and 105 of Article 8,Title 31,CRS 1973,as amended,have been met;
that an election was not required under Section 107(2)of said Article 8;
and that no additional terms and conditions were to be imposed upon said
annexation except those set out on said petition.
Section 2.That the annexation to the Town of Estes Park,
Colorado,of the following described territory,to he known and desianated
as “Binns Addition”to the Town of Estes Park,Colorado,is hereby approved:
A tract of land located in the Southwest quarter of
the Northeast quarter of Section 22,Township 5 North
Range 73 West of the 6th P.M.,described as follows:
Beginning at a point on the East line of said Southwest
quarter of the Northeast quarter that is North 000551
East 169.66 feet from the Southeast corner of said divi
sion (this corner being South $8°58’East 1301.0 feet
from the center quarter corner);thence South 73°5$’
West 42.12 feet to the Northerly right of way of State
Highway No.34;thence along the right of way of said
Highway No.34 Northwesterly along a curve to the left
whose radius is 804.0 feet a distance of 386.91 feet
(resultant chord being North 48°56’43”West 383.19
feet);this point being 62.0 feet from the point of
beginning of the curve (P.C.);thence North 27°16’06”
East 239.19 feet;thence South 89°05’East 227.07 feet
to the East line of the Southwest quarter of the North
east quarter;thence along this line South 00055I West
449.07 feet to the point of beoinning,County of Larimer,
State of Colorado;
Section 3.The Board of Trustees of the Town of Estes Park,
Colorado,herewith finds,determines and designates that this Ordinance is
necessary for the immediate preservation of the public peace,health and

safety,for the annexation of property to the Town of Estes Park,Colorado,
affects the public peace,health and safety;and whereas,in the opinion of
the Board of Trustees,an emergency exists,this Ordinance shall take effect
and be in force after its final passage,adoption and approval and signature
of the mayor.
