HomeMy WebLinkAboutRESOLUTION 58-20RESOLUTION58-20APPROVINGTHESECONDAMENDEDPLATOFESTESPARKRESORTTOWNHOMESUBDIVISION,TOWNOFESTESPARK,COLORADOWHEREAS,anapplicationforaSecondAmendedFlat,toprovideanadditionalgarageareaandslightlyreconfigureutilityeasementswithinaplatted“TownhomeSubdivision”wasfiledbyMountainVillageDevelopment,LLC(owner/applicant);andWHEREAS,theEstesParkResortTownhomeSubdivisionAmendedFlatNo.1isrecordedintherecordsoftheLarimerCountyClerkandRecorderatReceptionNo.20200018555,onMarch18,2020;and,andlocatedwithinanA(Accommodations)ZoningDistrict;andWHEREAS,thesubjectpropertyislocatedwithinanA(Accommodations)ZoningDistrict;andWHEREAS,theSecondAmendedFlatprovidesanadditionalgaragearea,andslightlyreconfiguresutilityeasements,withnootherchangestotheplatbeingproposed;andWHEREAS,apublicmeetingwasheldbeforetheEstesParkPlanningCommissiononSeptember15,2020,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindingsandconditionofapproval:Findings:1.ThisproposalcomplieswithapplicablesectionsoftheEPDC.2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Noissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.3.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalFlatapplication,thedevelopershallsubmittheplatforrecording.Iftheplatisnotsubmittedforrecordingwithinthissixty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.4.ThisisaPlanningCommissionrecommendationtotheTownBoard.5.StafffindsthatthetitleontheprovidedFlatislikelytobeconfusing.Thetitle(seeAttachment4)isgivenas“AmendedFlatofEstesParkResortAmendedFlat.”Staffrecommendsaconditionofapprovalthattheplatberetitledas“SecondAmendedFlatofEstesParkResort,”andthatanexhibitwiththerevisedtitlebeprovidedtostaffintimetoscheduleforTownBoardhearingandconsideration. ConditionsofApproval:1.Thisplatshallberetitledthe“SecondAmendedFlatofEstesParkResort”andaretitledexhibitprovidedpriortoschedulingforTownBoardhearingandconsideration.2.Theeasementshallberevisedtonotoverlapwiththestructureoflot27andreaddthearea’slineardescriptionnottobedisturbedontheproperty’ssouthwestcorner.WHEREAS,theapplicanthascompliedwithFindingNo.5andtheConditionsofApprovalaboveandthesearenolongerapplicable;andWHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonNovember10,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationofthePlanningCommissionandthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesParkDevelopmentCode.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheSecondAmendedFlatofEstesParkResortTownhomeSubdivisionisherebyapproved.DATEDthis1odayof,2020.ATTEST:nClerkROVEDASTOFORM:TOWNOFESTESPARKTownAttorney
