HomeMy WebLinkAboutRESOLUTION 59-20RESOLUTION59-20APPROVINGATWOYEAREXTENSIONOFTHETHREEYEARAPPROVALPERIODFORASPECIALREVIEWFORTHEWINDRIVERDAYCARECENTERWHEREAS,anS2SpecialReviewforaDayCareCenterwasapprovedbytheTownofEstesParkBoardofTrusteesonSeptember25,2018,withtheDayCareCenterbeingassociatedwiththeWindRiverApartmentsDevelopmentPlanproject;andWHEREAS,TheEstesParkDevelopmentCode(EPDC),Chapter3ReviewProceduresandStandards,Section3.5.SpecialReviewUses,Subsection3.5.0.Lapse,requiresanapplicanttoapplyforabuildingpermitorcommenceoperationwithregardtothespecialreviewusewithinthreeyearsoftheapproval;andWHEREAS,TheEPDCSubsection3.5.C.alsocontainsaprovisionwhereanapplicantmaypetitiontheBoardofTrusteestoapproveatwoyearextensionofthethreeyearapprovalperiodofthespecialreview;andWHEREAS,theowner/applicant,RuralCOZEstesParkStVram,LLC,doStephanieCopeland,citingdelaysprimarilycausedbychallengesrelatedtotheCOVIDpandemic,hasrequestedthethreeyearvestedpropertyrightperiodbeextendedbytwoadditionalyears,throughSeptember25,2023;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftheextensionrequest.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:AtwoyearextensiontothethreeyearapprovalperiodfortheS2SpecialReviewfortheWindRiverDayCareCenteruseisherebyapproved,extendingtheapprovalperiodthroughSeptember25,2023.DATEDthisI°ā€¯dayoftct-APPROVEDASTOFORM:TOWNQESTESPARK7Mayor///2020.ATTEST:ClerkTownAttorney
