00RESOLUTION#15-14WHEREAS,CDOTownsandmaintainsUSHighway34throughtheTownknownasElkhornAvenue;andWHEREAS,theTownistherecipientofagrant(the“FLAPGrant”)forthepurposefordesigningandconstructingroadimprovementstofacilitatetrafficflowinthedowntownarea(the“Project”);andWHEREAS,CDOThasagreedtoprovidefundingintheestimatedamountoffourmillion,twohundredthousanddollars($4,200,000)toassisttheTownwiththedesignandconstructionoftheProject;andWHEREAS,followingcompletionoftheProject,theportionofUSHighway34betweenMoraineAvenueandtheUSHighway34By-Pass(WestElkhornAvenue),willbedevolvedbyCDOTtotheTownandbecomepartoftheTown’sroadsystem.NOW,THEREFORE,BASEDUPONTHERECITALSSETFORTHABOVEWHICHAREINCORPORATEDHEREINBYREFERENCE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOASFOLLOWS:1.UponcompletionoftheProject,CDOTshalldevolveWestElkhornAvenuetotheTown,andtheTownshallacceptWestElkhornAvenueaspartoftheTown’sroadsystem.Datedthis_________________________2014.MayorATTEST:Tow3Ierk
