HomeMy WebLinkAboutRESOLUTION 32-14a,CRESOLUTIONNO.32-14ARESOLUTIONEXTENDINGTHESUSPENSIONOFUTILITYFEESFOR2013FLOODVICTIMSWITHHOMESANDBUSINESSESWITHOUTELECTRICORWATERSERVICEWHEREAS,inSeptember2013,severefloodingintheserviceareasoftheTown’sLight&PowerandWaterEnterprisesdamagedpublicandprivatepropertyandtheTown’sutilitydistributionsystems;andWHEREAS,somehomesandbusinessesweredestroyedordamagedandtheirelectricand/orwaterserviceisunavailable;andWHEREAS,pursuanttotheTown’sutilityrates,allcustomersarerequiredtopayminimummonthlyutilityfees;andWHEREAS,theBoardofTrusteesservesastheBoardofDirectorsfortheTown’stwoutilitiesandhastheauthoritytomodifyelectricandwaterchargesunderspecialcircumstances;andWHEREAS,onNovember12,2013,Resolution#32-13waspassedgrantingtemporarysuspensionoffixedmonthlyminimumutilitychargesforaperiodofoneyear,fromOctober1,2013toOctober1,2014;andWHEREAS,theTownBoardofTrusteeswishestoextendthesuspensionofmonthlyminimumchargesforutilitiesasprovidedinthisResolution.NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:1.ThemonthlyminimumchargesforwaterandelectricityforTowncustomersshallbefurthersuspendedunderthefollowingcircumstances:a)Anycustomerwhosestructurewasdestroyedorisunsafe,andtheirelectricorwaterserviceiscurrentlysuspendedduetotheservicebeingunavailablefromtheTown.2.ThesecustomersshallberequiredtoprovidewrittennoticetotheTownoftherestorationofutilityservice.1 003.ThesuspensionoftheminimumchargesshallberetroactivetoOctober1,2014,andshallbeeffectiveuntilOctober1,2018,oruntiltheutilityserviceisrestored,whicheverfirstoccurs.Datedthisdayof2014.ayorATTEST:T1jClerk—2
