HomeMy WebLinkAboutRESOLUTION 54-20RESOLUTION54-20ARESOLUTIONAPPROVINGTHEELKHORNLODGEFINALPLANNEDUNITDEVELOPMENT(PUD),AMIXEDUSEPUDOVERLAYONLANDZONEDCO(OUTLYINGCOMMERCIAL),LOCATEDONAPROPERTYADDRESSEDAS600WESTELKHORNAVENUE,DESCRIBEDASBEINGWITHINPORTIONSOFSECTIONS25AND26,TOWNSHIP5NORTH,RANGE73WESTOFTHE6THP.M.,TOWNOFESTESPARKWHEREAS,anapplicationfortheElkhornLodgeFinalPUDwasfiledbyEastAvenueDevelopment,LLC,aTexasLLC(applicant);andWHEREAS,thesubjectproperty,18.58±acresinsize,islocatedinportionsofSections25and26,Township5North,Range73Westofthe6thP.M.,TownofEstesPark,withthesamepropertyalsoproposedtobetheElkhornLodgeSubdivision;andWHEREAS,theEstesValleyDevelopmentCode,Chapter9PlannedUnitDevelopments,allowsaMixed-UsePUDoverlayonlandlocatedinCO(OutlyingCommercial)ZoningDistricts,withtheusespermittedinthePUDbeinglimitedtothoseusesallowedintheunderlyingCOzoning,Residentialuses,and/orAccommodationsuses;andWHEREAS,theproposedElkhornLodgeFinalPUDisaMixed-UsePUDoverlayonlandlocatedinaCO(OutlyingCommercial)ZoningDistrict,withtheusesproposedlimitedtothoseallowedintheunderlyingCOzoning,Residentialuses,andAccommodationsuses;andWHEREAS,theEstesParkBoardofTrusteesapprovedtheElkhornLodgePreliminaryPUDonJune23,2020byOrdinanceNo.05-20;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthattheElkhornLodgeFinalPUDcomplieswithapplicablestandardssetforthintheEstesParkDevelopmentCode.WHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonAugust11,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeofthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;and NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheElkhornLodgeFinalPlannedUnitDevelopmentisherebyapproved,withthefollowingfindingsandconditionsofapproval:Findings1.TheFinalPUDandFinalPlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesValleyComprehensivePlan.2.TheFinalPUDandFinalPlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesParkDowntownPlan.3.TheFinalPUDandFinalPlatcomplywithapplicablestandardssetforthintheEPDC.4.Adequatepublicfacilitiesarecurrentlyavailabletoservetheproposedproject.5.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereraisedbyanyreviewagency.ConditionsofApproval1.TheElkhornLodgeFinalPUDandFinalSubdivisionPlatapprovalaresubjecttotheconditionsandstipulationsasrecommendedbytheTownofEstesParkPublicWorksEngineeringDevelopmentReview,datedJuly21,2020andattachedtotheEstesParkDepartmentofCommunityDevelopmentstaffreportfortheElkhornLodgeFinalPUDandSubdivisionPlat,datedAugust11,2020.2.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalPUDandFinalPlat,thedevelopershallsubmittheFinalPUDandFinalSubdivisionPlatforrecording.litheplatandplanarenotbothsubmittedforrecordingwithinthissixty-daytimeperiod,bothapprovalsshallautomaticallylapseandbenullandvoid.DATEDthisdayof____________.2020.ATTEST:_____________.-_-.Z)----0TqClerkTOWNOFESTESPARK APPROVEDASTOFORM:TownAttorney
