2020-07-14TownofEstesPark,LarimerCounty,Colorado,July14,2020MinutesofaRegularmeetingoftheBoardofTrusteesoftheTownofEstesPark,LarimerCounty,Colorado.MeetingheldintheTownHallandVirtuallyinsaidTownofEstesParkontheI4thdayofJuly,2020.Present:WendyKoenig,MayorPatrickMartchink,MayorProTernTrusteesCarlieBangsMarieCenacBarbaraMacAlpineCindyYounglundVacantAlsoPresent:TravisMachalek,TownAdministratorJasonDamweber,AssistantTownAdministratorDanKramer,TownAttorneyJackieWilliamson,TownClerkAbsent:OneVacancyMayorKoenigcalledthemeetingtoorderat7:00p.m.andalldesiringtodoso,recitedthePledgeofAllegiance.PROCLAMATION—WAYNENEWSOM.MayorKoenigpresentedaproclamationhonoringtheserviceofWayneNewsomtotheEstesParkcommunityandTown.RESOLUTIONOFREPECT—TRUSTEEKENZORNES.MayorKoenigrecognizedtheserviceofTrusteeKenZornesduringApril2018throughJune2020.AGENDAAPPROVAL.TrusteeMacAlpinerequestedConsentItem#4beremovedandconsideredasanactionitem.Itwasmovedandseconded(MartchinklYounglund)toapprovetheAgendawiththeremovalofConsentItem4andadditasActionItem1,anditpassedunanimously.PUBLICCOMMENTS.None.TRUSTEECOMMENTS.TrusteeMacAlpineannouncedshewouldattendtheRegionalGovernmentRecoveryCollaborativemeetingonJuly16,2020todiscussrecoveryfromthepandemic.AttendedaLeagueofWomenVoterspresentationonCommunityBasedSocialMarketingfocusedonbehaviorchangeandfoundthediscussionwouldbeapplicabletotheongoingsituationrelatedtomaskwearing.She.requestedtheBoardconsidertheTown’sCOVIDprecautionsasthenumberofinfectionsanddeathscontinuetorise.TrusteeCenaccommentedtheVisitEstesParkBoard(VEP)heardaParkupdatefromKylePatterson/RMNPPublicAffairsOfficerinwhichshestatedthehikershuttlewouldnotoperatein2020,FallRiverroadhasopened,andvisitorsappeartobehappywiththereservationsystem.VEPhasseenalowerovernightstayratewhichwouldimpacttheVEP2021budget.MayorKoenigstatedsheattendedarecentBreckenridgevirtualTownBoardmeetinginwhichtheyconsideredamaskordinancefortheirdowntowncorridor.ColoradoAssociationofSkiTowns(CAST)sentalettertoGovernorPolisrequestingamaskordinance.Aspencontinuestoconsidermethodstoencouragevisitorstowearmaskssuchasamaskmonitordressedupasafriendlyclownoramime.TOWNADMINISTRATORREPORT.TownAdministratorMachalekstatedLarimerCountyManagerLindaHoffmanconfirmedtheCountyCommissionersarenotinterestedinreviewingtheLandUse BoardofTrustees—July14,2020—Page4unincorporatedarea;earlierBoarddiscussionswiththeCommissionersconfirmedtheirparticipationintheprocessandfundingwasstillupfordiscussion;andquestionediftheannexationareatobeconsideredintheplanwouldincluderezoningofproperties.Afterfurtherdiscussion,itwasmovedandseconded(Cenac/Martchink)toapproveResolution42-20tosubmittheDOLAEIAFgrantapplicationtodeveloptheComprehensivePlan,anditpassedunanimously.2.RESOLUTION44-20TOAPPROVEINTERGOVERNMENTALAGREEMENTANDBILLOFSALETOTRANSFERTHEDANNELSFIRESTATIONTOTHEESTESVALLEYFIREPROTECTIONDISTRICT.TownAttorneyKramerstatedthevotersapprovedthesaleoftheDannelsFireStationtotheEstesValleyFireProtectionDistrictduringtheregularMunicipalElectiononApril7,2020.TheresolutionwouldapproveanIntergovernmentalAgreementandBillofSaletofinalizethetransferandapproveanAccessandMaintenanceAgreementtoprovideaccesstoTowncommunicationfacilitieswithinthestation.Itwasmovedandseconded(Younglund/Martchink)toapproveResolution44-20toexecuteanddelivertheDeedandBillofSalefromtheTownofEstesParktotheEstesValleyFireProtectionDistrictfortransferoftheDannelsFireStation,andapprovetheIntergovernmentalAgreementforAccessandMaintenancetoTownCommunicationFacilitiesbetweentheTownofEstesParkandtheEstesValleyFireProtectionDistrict,anditpassedunanimously.3.AMENDMENTONETOTHESAFEBUILTCONTRACTFORBUILDINGPERMITTECHNICIANANDFEEOFFSETFORTOWN-OWNEDBUILDINGPROJECTS.DirectorHuntpresentedanamendmenttothecontractwithSafeBuilttoprovidebuildingsafetyservicesonbehalfoftheTowntoincludeBuildingPermitTechnicianservicesforanincreasefeecaptureto100%,andprovideSafeBuiltwouldchargetheTown50%ofthefeescheduleforTown-ownedprojectsratherthan100%.InJanuary2020,theTownemployedaBuildingPermitTechnicianwhohassinceresigned.TheTownwasunsuccessfulathiringareplacementduringthepeakseasonforbuilding,andthegapinservicewasnotsustainable.Itwasmovedandseconded(Younglund/Martchink)toapprovetheProfessionalServicesContractAmendmentOnewithSafeBuiltColorado,LLCforBuildingSafetyServicesforthecalendaryear2020,anditpassedunanimously.4.POLICY1101—DELEGATIONOFCONTRACTSIGNATUREAUTHORITY.TownAttorneyKramerpresentedapolicytoaddresssignatoryauthoritywithintheTownforcontractsandincludesasectiononthe“reservedauthority”foritemstheBoardwouldapproveandexecute.Thepolicywouldnotimpacttheapprovalprocessesestablishedinthepurchasingpolicies.Itwasmovedandseconded(Marichink/MacAlpine)toapprovePolicy1101,anditpassedunanimously.5.RESOLUTION45-20DECLARINGAVACANCYONTHEESTESPARKBOARDOFTRUSTEESANDAPPROVETHEPROCESSTOFILLTHEVACANCY.TownClerkWilliamsonpresentedaresolutiontoformallyaccepttheresignationofTrusteeZornesandoutlineaprocessforfillingtheposition.Asastatutorycommunity,theTownBoardmustfollowtheguidelinesoutlinedinC.R.S.31-4-303TrusteetoFillVacancy.ThestatuteprovidestheBoardwiththeauthoritytoappointareplacementwithin60daysofthevacancyorsetandelection.IftheBoardfailstoactwithin60days,theBoardmustsetaspecialelectionassoonaspractical.StaffprovidedtheBoardwithaproposedapplicationprocessconsistingofanapplicationandresume,apublicinterviewconductedbytheBoardandavoteoftheBoardtoappointanindividual.AstheTownhelditsregularlyscheduledMunicipalElectiononApril7,2020,theBoardmayconsidertheappointmentofthefourth-placecandidateintheelectiontofillthevacancy.BoarddiscussionfollowedwithMayorKoenig,TrusteeMacAlpineandTrusteeYounglundstatingsupportfortheappointmentofthefourth-placecandidate.MayorProTernMartchinkstatedsupporttoscheduleaspecialelectiontoallowthevoterstodeterminewhoshouldcompletethetermheldbyTrusteeZornes.TrusteesBang BoardofTrustees—July14,2020—Page5andCenacwouldsupportcompletingantheappointmentprocessasoutlined.Afterfurtherdiscussion,itwasmovedandseconded(Cenac/Bangs)toapproveResolution45-20,anditpassedunanimously.Itwasmovedandseconded(Younglund/Bang)toextendthemeetingpast10:00p.m.,anditpassedunanimously.Asubstitutemotionwasmovedandseconded(Bangs/Cenac)toapprovetheappointmentprocessasoutlined,andthemotionfailedwithMayorProTemMartchink,TrusteesBangsandCenacvoting“Yes”andMayorKoenig,TrusteesMacAlpineandYounglundvoting“No”.Itwasmovedandseconded(Younglund/MacAlpine)toapprovetheappointmentofthefourth-placecandidate,ScottWebermeier,anditpassedwithMayorProTemMartchinkandTrusteeCenacvoting“No”.5.REPORTSANDDISCUSSIONITEMS:1.OPENCONTAINERSWITHINTHETOWN.TownAdministratorMachalekprovidedastaffrecommendationtopermittheconsumptionofalcoholicbeveragesinspecificTown-ownedparksbetweenthehoursof9amto9pm.Noglasscontainerswouldbepermitted.HestatedthePolicewouldcontinuetoberesponsibleforenforcingtheopencontainerlawwithintownlimits,andthemodificationoftheopencontainerregulationasoutlinedwouldnotcreateasubstantiallydifferentordifficultenforcementenvironmentforthePolice.TheenforcementworkloadhasincreasedduetotheStateregulationsthatallowtakeoutdrinksfromliquorlicensedestablishments.Asurveywasconductedoftheliquorlicensedestablishmentstodeterminewhetherrelaxingtheopencontainerlawwouldbebeneficialtotheirbusiness.Ingeneralbusinessesrespondedthemodificationasoutlinedwouldbebeneficialtotheirbusiness.Boarddiscussionwasheardandsummarized:thesurveyshouldhaveclarifiedthemodificationwouldallowindividualstobringtheirownalcoholtotheparksandwhatimpactthatmayhaveonabusiness;concernwiththeimpactonstaffingrelatedtoenforcementoftheopencontainers;thepotentialofcongregationinparksandindividualsnotmaintainingsocialdistancing;surveyquestionsshouldbemorespecific;theopencontainermodificationwouldbenefitthosebusinessesthathavebeenshutdowntoonpremiseconsumptionsuchasbarsandtaverns;notconcernedwithpublicperceptionofdrinkingonthesidewalksdowntown;theintentoftake-outdrinksbytheStateistotakethealcoholhome;thediscussionshouldbecontinuedtothefall;encouragingalcoholconsumptionoutdoorswouldbesaferthandrinkingindoorsasitrelatestoCOVID-19;andthemajorityofvisitorsaredaytripperswhowouldconsumethetake-outalcoholdowntownonthesidewalksandparks.TheBoardconsensuswastobringthediscussionbacktotheAugust11,2020Boardmeetingwithanaddendumtothesurveyasareportanddiscussionitem.WhereuponMayorKoenigadjournedthemeetingat11:04p.m.‘endy,,ØrI,MakieWilliamson,TownClerk
