0RESOLUTION13-88RESOLUTIONCONSENTINGTOANDJOININGTHECOUNTYOFLARIMERINTHEESTABLISHMENTOFTHEESTESVALLEYPUBLICLIBRARYDISTRICTINAPORTIONOFLARIMERCOUNTYANDAGREEINGTOMERGETHEESTESPARKPUBLICLIBRARYWITHTHEESTESVALLEYPUBLICLIBRARYDISTRICT,IFESTABLISHED.WHEREAS,theTownofEstesPark(the“Town”)isadulycreated,organizedandexistingtownunderthelawsoftheStateofColorado(the“State”);andWHEREAS,themembersoftheBoardofTrustees(the“Board”)oftheTownhavebeendulyelected,chosenandqualified;andWHEREAS,undertheprovisionsofTitle24,Article90,Part1,ColoradoRevisedStatutes(the“Act”),alibrarydistrictmaybeestablishedwithintheboundaries(orportionsthereof)oftwoormoregovernmentalunitsbypetitionofonehundredregisteredelectorsresidingwithintheproposedlibrarydistrictaddressedtothelegislativebodyofthegovernmentalunitintheproposedlibrarydistricthavingthelargestpopulationaccordingtothemostrecentfederalcensus;andWHEREAS,apetition(the“Petition”)hasbeensubmittedtotheBoardofCountyCommissioners(the“Commissioners”)ofLarimerCounty(the“County”)requestingthattheCommissionerssubmitthequestionofestablishingtheEstesValleyPublicLibraryDistrict(the“District”)toavoteoftheregisteredelectorsresidingwithintheproposedDistrictattheNovember8,1988generalelection;WHEREAS,thePetitionalsorequeststhattheCommissionerssubmittosuchelectorsthequestionofincreasing—2— 00themaximumauthorizedmilllevyfortheestablishmentandmaintenanceoftheDistrictfromoneandone—halfmillstotwoandone-halfmills,iftheDistrictisorganized;andWHEREAS,theCommissionershavedeterminedthatthePetitionissufficient,thattherequirementsoftheActhavebeencompliedwithandthatitisinthepublicinteresttosubmitthequestionsoftheestablishmentoftheproposedDistrictandtheincreaseinmaximummilllevytotheregisteredelectorsresidingwithintheboundariesoftheproposedDistrictattheNovember8,1983generalelection;andWHEREAS,theboundariesoftheproposedDistrictarethecurrentboundariesoftheParkHospitalDistrictinaportionoftheCountyandincludeterritorywithintheTown;andWHEREAS,theTowncurrentlymaintainsapubliclibraryknownasthe“EstesParkPublicLibrary”withinitsboundaries;andWHEREAS,theBoardnowdeemsitnecessaryanddesirablethataresolutionbeadoptedconsentingtoandjoiningtheCountyintheestablishmentoftheDistrictandagreeingtomergetheEstesParkPublicLibrarywiththeproposedDistrictifitisorganized.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK:Section1.Allactionheretoforetaken(notinconsistentwiththeprovisionsofthisresolution)bytheBoardandtheofficersthereof,directedtowardtheobjectsandpurposeshereinstatedbe,andthesameherebyis,ratified,approvedandconfirmed.—3— 00Section2.TheBoardhasdetermined,andherebydetermines,thatthepublicinterestrequiresthattheTowncooperatewiththeCountyandbeservedbytheDistrictiftheDistrictisestablished.-Section3.PursuanttoSection110oftheAct,iftheDistrictisestablished,theTownintendstoenterintoanagreementwiththeboardoftrusteesoftheDistricttomergetheEstesParkPublicLibrarywiththeDistrict.Section4.IftheDistrictisestablished,theBoardintendsa)toappointtwoofitsmemberstoparticipatewiththeCommissionersonacommitteewhichwillappointthemembersoftheboardoftrusteesoftheDistrictandb)toparticipateintheratificationofsuchtrusteeappointments,allinaccordancewiththeAct.Section5.TheofficersoftheBoardandtheTownbe,andtheyherebyare,authorizedanddirectedtotakeallactionnecessaryorappropriatetoeffectuatetheprovisionsofthisresolution.Section6.Allorders,bylawsandresolutions,orpartsthereof,inconflictwiththisresolution,areherebyrepealed.Section7.Ifanysection,paragraph,clauseorprovisionofthisresolutionshallforanyreasonbeheldtobeinvalidorunenforceable,theinvalidityorunenforceabulityofsuchsection,paragraph,clauseorprovisionshallnotaffectanyoftheremainingprovisionsofthisresolution.Section8.Thisresolutionshallbeinfullforceandeffectfromandafteritsadoption.—4—
