22-89aTOWNOFESTESPARK,COLORADORESOLUTIONNO.22-89ARESOLUTIONMODIFYINGTHEESTESPARKDOWNTOWNREDEVELOPMENTPROGRAMTOINCLUDEADDITIONALREALPROPERTYWITHINTHEREDEVELOPMENTAREA,FINDINGTHEEXISTENCEOFBLIGHTTHEREIN,ANDTHENEEDFORTHEDEVELOPMENT,REDEVELOPMENTANDREHABILITATIONOFSAIDAREA.WHEREAS,ithasbeenproposedthattheBoardofTrusteesoftheTownofEstesParkmodifytheEsteeParkDowntownRedevelopmentProgram(Plan)byincludingthepropertydescribedonExhibitAheretoandincludedhereinwithintheDowntownRedevelopmentAreaaspartoftheurbanrenewalarea(RedevelopmentArea)withintheTownofEsteePark;andWHEREAS,ithasbeendeterminedthattheproposedmodificationtothePlanissubstantial;andWHEREAS,inaccordancewiththeUrbanRenewalLawoftheStateofColorado,asubstantialchangetoanurbanrenewalplanmustbereviewedpursuanttoapublichearingbeforetheTownBoard;andWHEREAS,requirednoticeofthepublichearingregardingtheproposedmodificationtothePlanhasbeenlawfullymadeandapublichearingthereonhasbeenheld;andWHEREAS,evidencehasbeenpresentedtotheTownBoardthatthepropertytobeincludedwithintheRedevelopmentAreacontainselementsofblightasdefinedbyColoradolaw;andWHEREAS,theinclusionofthesubjectpropertywithintheRedevelopmentAreawouldaccomplishthedevelopment,redevelopmentandrehabilitationoftheblightedarea,sothattheareacanbedevelopedorredevelopedtoprovideasaferandmoreusefulenvironmentforitsusersandinhabitants;todevelopandredevelopsuchpropertytoprovidenecessary,greaterandreasonableeconomicutilizationofsucharea;topromoteandprovidepublicfacilities;toeliminatetrafficandpedestrianhazardswithinthearea;toensurereasonedandsoundsocial,physicalandeconomicgrowthwithintheTown;topromoteandeffectthegoals,objectivesandpurposesofthePlan;toprovideasoundfinancialandeconomicbaseforthecommunity;andtoprovideanecessarytaxbasefortheTown;andWHEREAS,theTownBoardhasdeterminedthatitisinthebestinterestoftheTownofEstesParkandtheEsteeParkUrbanRenewalAuthority,tomodifythePlanasproposed;and 00WHEREAS,theproposedmodificationhasbeensubmittedtotheEstesParkPlanningCommission,whohasrecommendedthattheproposedmodificationisinconformancewiththeEstesParkComprehensivePlanandalsorecommendedthatthepropertydescribedinExhibitAbeincludedwithintheRedevelopmentArea;andWHEREAS,theTownClerkhascausednoticeofthetime,placeandpurposeofapublichearingtobeheldconcerningthemodificationstothePlantobepublishedSeptember15,1989,intheEstesParkTrailGazette,anewspaperofgeneralcirculationintheTown;andWHEREAS,atthepublichearingbeforetheTownBoardonSeptember26,1989,evidencewaspresentedwhichsupportsthefindingscontainedhereinthatcertainareaswithintheproposedRedevelopmentAreaarepresentlyinablightedconditionandareinneedofdevelopment,redevelopmentorrehabilitation,oracombinationthereof;andWHEREAS,atsaidhearingallresidentsandtaxpayersoftheTownandallotherinterestedpersonsweregivenafullopportunitytobeheard.NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.OneormoreblightedareasexistintheareaoftheTowntolieaddedtotheRedevelopmentAreawhich,byreasonofthefollowingfactors,substantiallyimpairorarrestthesoundgrowthoftheTown,constituteaneconomicandsocialliability,andareamenacetothepublicsafetyandwelfareintheirpresentconditionsanduses.Specifically,thefollowingblightfactorsexist:A.Thedeteriorationofimprovements,facilitiesandsites;andB.Unsanitaryandunsafeconditionsincludingtheaccumulationoftrash,weedsandabandonedandinoperablevehicles;andC.Defectivestreetlayout,andinadequatefacilitiesforvehicular,bicycleandpedestriantrafficanduses,accessorcirculation;andD.Faultylotlayoutinrelationshiptosize,adequacy,accessibility,orusefulness;andE.Obsoleteorinadequateuseofland;andF.Substantialimpairmentofthesoundgrowthofthecommunitybyconflicting,incompatibleusesofproperty,and2 00 amultipleownershipofpropertywhichpreventredevelopmentandrehabilitationoftheareainanadequatelyplannedcohesivemanner;andG.Practicalandeconomicunder—utilizationofland;andH.Failuretomeettheeconomicneedsofthecommunitywithinthegeneralarea.Section2.TheTownBoardherebyfindsthat:A.ThepropertiestobeincludedintheRedevelopmentArea,asdescribedinExhibitA,containblightasdefinedbyColoradolaw;andB.TheexistenceoftheblightedconditionsreferredtoinSectionOnesubstantiallyimpairandarrestthesoundgrowthofthemunicipality,constituteaneconomicliabilityandareamenacetothepublicsafetyandwelfareinthepresentconditionsanduses;andC.Therehabilitation,conservation,development,redevelopment,oracombinationthereof,oftheRedevelopmentAreaisnecessarytopreserveandensurethepublicsafetyandwelfareofthecommunity;andD.Theareaisappropriateforanurbanrenewalproject;andE.RedevelopmentoftheRedevelopmentAreashallpreventfurtherdeterioration;andF.ThenonresidentialusesproposedfortheRedevelopmentAreaarenecessaryandappropriatetofacilitatethepropergrowthanddevelopmentofthecommunityinaccordancewithsoundplanningstandardsandlocalcommunityobjectives.ItisnotcontemplatedthattheacquisitionofpropertieswithintheRedevelopmentAreamayrequiretheexerciseofgovernmentalactionasprovidedintheUrbanRenewalLaw.;andG.ThePlanprovidesafeasiblemethodfortherelocationofthepersonsandbusinesseswithintheRedevelopmentArea;andH.ThemodificationsofthePlanconformtotheEstesParkComprehensivePlan.Section3.ThemodificationsofthePlanshallaffordmaximumopportunity,consistentwiththesoundneedsoftheTownofEstesPark,fortherehabilitationandredevelopmentoftheRedevelopmentAreabyprivateenterprise.Section4.ModificationstothePlanareherebyapprovedandadoptedascontainedinthedocumententitledFIRSTMODIFICATION3
