0..0FORMBRESOLUTION#25-90JEFFTHUSTJEFFIRUSTJEFFERSONCOUNTYCOLORADOSURPLUSFUNDSTRUSTAResdtutionauthorizingTheTownofEstesParktoJoinwithotherPubticEntitiesasaNameofPublicEntityParticipantintheJeffersonCountyCoLoradoSurptusFundsTrust(JEFFIRUST)inordertopooifundsforinvestment.WHEREAS,pursuanttoC.R.S.26-75-701etseq.,asamended,itistawfutforanycounty,cityandcounty,city,town,schootdistrict,orspecialdistrict(“PublicEntity”)topoolanymoniesinitstreasury,whicharenotirimediatetyrequiredtobedisbursed,withthesamesuchmoniesinthetreasuryofanyotherPublicEntityinordertotakeadvatageofshort-terninvestmentsandmaximizenetinterestearnings;andWHEREAS,JEFETRUSTisatrustformedunderthelawsoftheStateofColoradoinaccordancewiththeprovisionsofC.B.S.24-75-601atseq.,C.B.S.24-75-701atseq.,C.B.S.11-10.5-101otseq.,nrJC.B.S.11-67-101atseq.,allasamended,forpurposeofinvesting,pooLingforinvestment,andprotectingpublicfunds;andWHEREAS,thisPublicEntitydesirestobeaParticipantinJEFFIRUSTinaccordancewiththetermsandprovisionsthereof.NOW,THEREFORE,thegoverningbodyofTheTownofEstesParkbyamajorityvote,herebyNameofPublicEntityRESOLVESasfolLows:1.ThisPublicEntity,_TheTownofEstes__PaCbYapprovesandadopts,andtherebyjoinsasaParticipantwithotherPublicEntitiespursuanttoC.B.S.26-75-701etseq.,asamended,thatcertainIndentureofTrustentitledtheJeffersonCountyCotoradoSurplusFundsTrust(JEFFTRUST)datedasofSepterther27,1988,asamendedfromtimetotime,thetermsofwhichareincorporatedhereinintheirentiretybythisreferenceandacopyofwhichshaltbefiledwiththeniuntesofthemeetingatwhichthisResolutionwasadopted;and2.MonteVavrawhoistheLocalgovermoentofficialemrpoweredtoinvestthefundsinthisPublicEntity’streasury,isherebydesignatedthe“treasurer”asthattermIsdefinedintheindentureofTrust,andassuchisherebydesignatedasthisPublicEntity’sofficiatrepresentativetoJEFFIRUSIandshallserveasamotheroftheBoardofSupervisorsofJEFFIRUSTandisherebyauthorizedanddirectedtoexecutetheindentureofTrustandsuchotherdoctznentsasarerequiredandtoserveasametheroftheBoardofTrusteesitelectedbytheSupervisoryBoard;and3.The“Treasurer”designatedinSection2aboveisherebyauthorizedtoinvestfromtimetotimethemoniesinthisPublicEntity’streasurywhicharenotimnnediotclyrequiredtobedisbursed,inJEFFTRUSTbypurchasingShoresinJEFFIRUSTfromtimetotimewithavailablefunds,oixitoredeemimsommieoroIlofthosoSharesfromtimetotimeasfundsarcneededforotherpurposes.6.TheBoardofTrusteesofJEFFIRUST,ortheirsuccessorsinfunction,isherebydesignatedastheofficialcustodianofsuchfundsasaredepositedinJEFFTRUSTbythisPublicEntityduringsuchtimeortimesas 00‘3, CCfundsmaybeonicposltwithJEFFIRUST.TheBoardofTrusteesofTheundersignedcertifythatTheTownofEstesParkhasenacted:NameofPublicEntityxThisResotution.________AnotherformofresoLution,ecopyofwhichIsencLosed,andthatthisresolutioniscurrentlyineffect.TheundersignedaffirmthatthisPublicEntityhasreceivedandreadtheTrust’sInformationStatementandAddendtintoInformationStatementendIndentureofTrustandagreetobeboundbythetermsthereof.Theundersignedagreethatthecertifications,instructions,andauthorizationscontainedintheattachedTrustRegistrationForm(whichismadeaparthereof)wiltremainineffectuntilreceiptbytheTrustofwrittennoticeofchange.NameofPubLicEntityTheTownofEstesParkfly:MonteVavraFinancialOfficerPLeasePrintName/SignatureTitle/AttesU______XdF’(dt(CLerkDate;EAL) 00
