C0RESOLUTION12-90WHEREAS,thePlatteRiverPowerAuthority(PlatteRiver)holdscontractallotmentsforColorado-BigThompson(CBT)water,acquiredin1979and1980;andWHEREAS,saidwatersareheldintrustbytheCityofLongmont;andWHEREAS,pursuanttoResolutionNo.20-90,PlatteRiverhasdeterminedthatitnolongerhasaneedfortheCBTwater;andWHEREAS,pursuanttoResolutionNo.20-90,theGeneralManagerofPlatteRiverhasbeenauthorizedtotransferPlatteRiver’scontractallotmentsofCBTwatertotheMunicipalitiesofEstesPark,FortCollins,LongmontandLovelandatapriceof$1,200.00perunit,andWHEREAS,EstesPark’sshareofPlatteRiver’sCBTallotmentis132units;andWHEREAS,theBoardofTrusteesherebydeterminesthatthefutureneedsoftheTownofEstesParkforareliablerawwatersupplytoinsurethatadequaterawwaterisavailableforusebytheTownofEstesParkanditswatersystemwouldbeenhancedbythetransferofPlatteRiver’scontractallotmentsfor132unitsofCBTwatertoEstesPark;andWHEREAS,theBoardofTrusteeshavedeterminedthatthepurchasepriceof$1,200.00perunitrepresentsafairandreasonableconsiderationforthetransferofthecontractallotmentsfor132unitsofCBTwaterfromPlatteRivertotheTownofEstesPark;andWHEREAS,thereisadequatemoneysalreadyappropriatedintheWaterFundoftheTownofEstesParktoaccomplishthetransferofthe132unitsofCBTwaterfromPlatteRivertotheTownofEstesPark.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.TheTownofEstesParkherebyacceptstheofferofPlatteRiverPowerAuthoritysetforthintheResolution20-90ofthePlatteRiverPowerAuthorityandsupplementedbytheletterofApril27,1990fromThaineMichie,GeneralManagerofPlatteRiverPowerAuthority,toGaryKlaphake,TownAdministratoroftheTownofEstesPark. i:--C,----f.Lr-.,:-2-00 C2.TheappropriateofficialsoftheTownofEstesParkareherebyauthorizedtotransferthesumof$158,400.00toPlatteRiverPowerAuthoritytoaccomplishthetransferof132unitsofCBTwaterfromPlatteRiverPowerAuthoritytotheTownofEstesPark.3.TheappropriateofficialsoftheTownofEstesParkarefurtherauthorizedtodoanyandallactionsnecessarytoaccomplishthetransferofthe132unitsofCBTwatercurrentlyheldintrustforPlatteRiverPowerAuthoritybytheCityofLongmonttotheTownofEstesPark.Datedthis_____dayofMay,1990.TOWNOFESTESPARK%7MBy:Ma7orATTEST:TownClerk 0.0:7
