RESOLUTION40-20-AARESOLUTIONUPHOLDINGTHEDECISIONOFTHEBUILDINGOFFICIALWHICHDENIEDACERTIFICATEOFOCCUPANCYFORTHEJIMMYJOHN’SGOURMETSANDWICHESSTOREWITHINTHEALARADOBUSINESSPARKDEVELOPMENTWHEREAS,anapplicationforacertificateofoccupancyfortheJimmyJohn’sGourmetSandwichesstore,withintheAlaradoBusinessParkdevelopment(“Application”),wasreviewedbytheCommunityDevelopmentDepartmentandwasnotapproved;andWHEREAS,theapplicanthasappealedthatdenialofacertificateofoccupancytotheTownBoardundersection14.04.020(b).NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:TheTownBoardmayoverturnthedenialofthecertificateofoccupancyonthebasisthatsuchdenialisnotjustified,isbasedonanunreasonableprovisionofthebuildingcodeorthatanunduehardshipwouldbeimposedupontheapplicantbythestrictcompliancewiththecode.Section2:TheBoardhaspresentedattheappealhearing.denialisjustified,isnotbasedonthatnounduehardshipwouldwiththecode.Section3:Accordingly,denyingtheApplication.consideredtherecordbeforeit,includingevidenceOnthebasisofthisrecord,theBoardfindsthattheanunreasonableprovisionofthebuildingcode,andbeimposedupontheapplicantbythestrictcompliancetheBoardupholdsthedecisionoftheBuildingOfficialDATEDthisZ-ayofATTEST:TnClerkC)APPROVEDASTOFORM:2020.TOWNOFESTESPARKTownAttorney
